THIS AGREEMENT made the
between LUTTRELL HOMES, INC.,
/ ~/-day of August, 2003, by and
of 3606 Roundtop Road,
Elizabethtown, PA 17022, hereinafter referred to as Contractor,
AND ROBERT A. BEERS and CYNTHIA L. BEERS, husband and wife, of
781 Old Silver Spring Road, Mechanicsburg, PA 17050, hereinafter
referred to as Owner, whereby the former undertook and agreed to
erect and construct a single-family residential dwelling on that
certain lot of ground situate on Lot No. 76 in the
Preliminary/Final Re-Subdivision Plan - Lot 76 in Section II
Phase I - Meado~view Estates, said plan being recorded in Plan
Book ~, Page ~ ~ . Being a part of the same premises which
Merle L. Stambaugh, Executor of the Estate and under the Last
Will and Testament of Mary G. Stambaugh, et al, by Deed dated
March 28, 1991 and recorded in the Cumberland County Recorder of
Deeds Office in Deed Book "A", Volume 35, Page 403, granted and
conveyed unto John M. Knaub and Janet D. Knaub. The said Janet
D. Kanub died March 26, 1995, whereupon full and complete title
to the described property became vested solely in John M. Knaub,
surviving spouse. Also being the same premises which John M.
Knaub, by Deed dated August ~ , 2003 and recorded in the
Cumberland County Recorder of Deeds Office in Deed Book
Page granted and conveyed unto ROBERT A. BEERS and
CYNTHIA L. BEERS, husband and wife.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.
WITNESS our hands and seals, or if a corporation, it has
caused these presents to be signed by its proper corporate
officers and its corporate seal to be affixed hereto, the day and
year above written.

acknowledged himself to be the President of Luttrell Homes, Inc.,
a corporation, and that he as such President, being authorized to
do so, executed the foregoing instrument for the purposes therein
contained.
