WHEREAS, KOLLAS AND COSTOPOULOS, of 1104 Fernwood Avenue,
Camp Hill, Cumberland County, Pennsylvania, hereina!%r referred to as Owner, is about to
execute contemporaneously herewith, contracts, with CENTRAL PENN ASPHALT, INC.,
4825 Derry Street, Suite B, Harrisburg, Pennsylvania 17111, for the excavation of land,
construction of improvements, and paving of roads in a development known as Wertz Run
Heights, Phases V and VI, Cumberland County, Pennsylvania, described as follows:
ALL THAT CERTAIN tract or parcel of ground in North Middleton Township,
Cumberland County, Pennsylvania, more particularly bounded and described as set forth in
Exhibit "A" attached hereto and made a part hereof.
NOW, this 24~ day of July , 2003, at the time of and immediately before the
execution of the contracts dated July 24 , 2003, and before any authority has been given by the
said Owner, to the said Contractor to commence work on the said excavation or construction, or
purchase materials for the same in consideration of the making of the said contracts with Owner,
and the further consideration of One Dollar and 00/100 ($1.00), to Contractor paid by Owner,
and intending to be legally bound hereby, it is agreed that no lien shall be filed against the real
property or improvements thereon by the Contractor, or any sub-contractor, nor by any of the
material men or workmen or any other person for any labor, or materials purchased, or extra labor
or materials purchased for the excavation or construction, the right to file any such lien or liens
being expressly waived.
