THIS AGREEMENT made this ~ day of~~, 2003, by and
between Hoffman Custom Contracting, Inc., ' 35 Chelsea Lane,
Carlisle, Pennsylvania hereinafter referred to as Contractor,
TER~RNCE B. ZI~R4EI~MAN AND JOANNE ZII~4ERMAN, husband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in Dickinson Township, C,,m~erland CountM,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot 16
Kings Gap Estates, Carlisle, Cumberland County, PA.
NOW THEP~FORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1~00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN lot of land situate in Dickinson Township, Cumberland
County, Pennsylvania, bounded and described in accordance with Final Subdivision
Plan of Kings Gap Estates recorded on April 10, 1992 in the hereinafter named
Rccorder's Office in Plan Book 64, Page 48, etc., as follows:
BEGINNING at a point on the western line of 60 feet wide Chelsea Lane at the
dividing line between Lots Nos. 15 and 16; thence along said western line of 60 feet
wide Chelsea Lane, South 08 degrees 36 minutes 27 seconds East a distance of
191.73 feet to a point at the dividing line between Lots Nos. 16 and 17; thence along
said dividing line between said Lots Nos. 16 and 17, South 74 degrees 50 minutes 45
seconds West, a distance of 347.26 feet to a point in line of land now or formerly of
Charles D. Smith; thence along line of said land now or formerly of Charles D.
Smith, North 08 degrees 36 minutes 27 seconds West, a distance of 210.07 feet to a
concrete monument at the dividing line between said Lots Nos. 15 and 16; thence
along said dividing line between said Lots Nos. 15 and 16, North 77 degrees
51minutes 26 seconds East a distance of 345.66 feet to a point on the western line of
60 feet wide Chelsea Lane at the Place of BEGINNING.
THE ABOVE described Lot of land is ali of Lot No. 16 as shown on said Final
Subdivision Plan of Kings Gap Estates recorded as aforesaid.
THE ABOVE described lot of land has a mailing address of 19 Chelsea Lane,
Carlisle, PA 17013.
