SECHRIST, of the Borough of Mechanicsburg, County of Cumberland, and Commonwealth of Pennsylvania, being of sound and disposing mind, memory and understanding, do make, publish and declare this as and for my Last Will and Testament, hereby revoking and making void all former wills and codicils by me at anytime heretofore made. FIRST. I order and direct that all my just debts and funeral expenses be paid by my Executrix or Executor, as the case may be, hereinafter named, as soon as conveniently may be done after my decease. SECOND. I give, devise and bequeath all the rest, residue and remainder of my Estate, real, personal and mixed, whatsoever and wheresoever situated unto my wife, namely, LOIS J. SECHRIST, absolutely and in fee simple, if she survives me by as many as sixty (60) days. THIRD. If my wife, LOIS J. SECHRIST, does not survive me by as many as sixty (60) days, then and in that event, I give, devise and bequeath all the rest, residue and remainder of my Estate, real, personal and mixed, whatsoever and wheresoever situated, in equal shares, unto my two (2) children, namely, STANLEY E. SECHRIST and ERIC L. SECHRIST, slime and share ~:. alike, absolutely, and in fee simple. _ . --~~- . ,.. If either of my said children should predecease me and leave lawful issue to stkrvi~e'me, ' _. then and in that event, I give, devise and bequeath the share of my residuary estate attributable to such deceased beneficiary unto his or her issue per stirpes by representation and not per capita, subject, however, to the protective trust provisions as contained in Item Fourth hereinbelow with respect to any beneficiary who has not attained the age of twenty-five (25) years at the time of my death. FOURTH. I order and direct that the distributive share hereinabove to any beneficiary who has not attained the age of twenty-five (25) years at the time of my death, shall be delivered and paid over to my testamentary trustee, hereinafter named, IN TRUST, NEVERTHELESS, to hold, manage, invest, accumulate income and reinvest until the beneficiary attains the age of LAW OFFICES SNELBAKER 8c BRENNEMAN, P.c. twenty-five (25) years, at which time said trust shall be terminated and the then remaining net balance of the corpus of said trust and any uninvested income shall be paid over to the beneficiary absolutely. During the existence of any such trust, (a) I authorize and empower said Trustee to manage said trust as a prudent investor and not be limited to statutory investments for fiduciaries, and (b) I order and direct that said trust shall be administered as a spendthrift trust, which shall be construed in its broadest terms under the law of the Commonwealth of Pennsylvania so as to prevent the beneficiary from obtaining, assigning, pledging or otherwise using the assets of said trust prior to attaining the age of twenty-five (25) years, and any such attempt to obtain, assign, pledge or otherwise use said assets shall be void and of no legal effect whatsoever. I further authorize and empower my said Trustee to use, consume, expend, and apply from time to time such amounts of income and principal of and from said trust which in the exercise of its sole discretion shall be determined to be reasonable and necessary for the beneficiary's education. The term "education" shall be construed and interpreted to mean college or other post-high school training which is intended to improve the beneficiary's productivity as an adult or enhance the quality of his or her life. In considering what is reasonable and necessary, my said Trustee will take into consideration the primary responsibility of the beneficiary's surviving parent to provide such education. It is my will and intention that the foregoing discretionary provision for education shall be supplementary to the parent's primary responsibility. FIFTH. I nominate, constitute and appoint my son, namely, STANLEY E. SECHRIST, to be the Trustee under Item Fourth hereinabove with respect to the beneficiaries who are the issue of ERIC L. SECHRIST. I nominate, constitute and appoint my son, namely, ERIC L. SECHRIST, to be the Trustee under Item Fourth hereinabove with respect to the beneficiaries who are the issue of STANLEY E. SECHRIST. LASTLY. I nominate, constitute and appoint my wife, namely, LOIS J. SECHRIST, to be the Executrix of this, my Last Will and Testament, but if for any reason she LAW OFFICES II SNELBAKER SC BRENNEMAN, P.c. should fail to qualify as such Executrix or cease so to serve, then and in that event, I-nominate, constitute and appoint my son, namely, ERIC L. SECHRIST, to be the Executor hereof. If both -2- f the foregoing persons should fail to qualify as my personal representative hereunder or cease o to serve, then and in that ultimate event, I nominate, constitute and appoint my son, namely, TANLEY E. SECHRIST, to be the Executor of this, my Last Will and Testament.
