Erie is subrogated to its insured, Joan Sunday, in connection with a loss that occurred on May 22, 2006, which is the incident giving rise to this matter. 3. Pursuant to the Soldiers and Sailors Civil Relief Act of 1940, as modified b;y the Sen'icemembers Civil Relief Act of 2003, this affidavit is submitted as proof that Alfredo Cruz is not presently in active service in any branch of the United States 1V~iilitary. 4. As proof of the military/non-military status of Alfredo Cruz, the undersigned contacted the Defense Manpower Data Center which provided written verification of such status, attached hereto as Exhibit A. 5. The foregoing information is true to the best of my knowledge and belief.
