On March 14 , 2006 Judge Kevin Hess appointed the Cumberland CO.~ Office:of
Aging Emergency Plenary Guardian of Person for Nancy Hoerner. Farrowing thg
hearing Ms. Hoerner was returned to the Shaffer Home where had been staying
since being evicted from the Homeless Shelter. On March 31 , 2006 we were
notified that client had to leave the Shaffer Home because of her behavior. Office of
Aging staff contacted numerous facilities until we were able to find temporary
placement in a personal care home in Franklin County where she was taken the next
day.
On April 6, 2006 following another hearing Judge Hess appointed the Cumberland
County Office of Aging Nancy's Permanent Plenary Guardian. On April 18, 2006
Ms. Hoerner was taken to the Behavioral Health Unit of Chambersburg Hospital.
Following treatment, she was admitted to the South Mountain Restoration Center,
South Mountain, PA. In order to find both temporary and permanent placement
contacted 30 facilities in 11 counties before she was accepted at South Mountain.
Nancy has been diagnosed with alzheimer's type dementia, chronic schizophrenia,
adjustment disorder with disturbance of conduct, and cognitive disorder.
Nancy seems to have adjusted well to life at South Mountain. She has had
occasional disagreements with other residents but the facility's staff has done a
good job in addressing these issues and helping Nancy adjust.
The Cumberland County Office of Aging contacted Franklin County Office of Aging
about beginning the process of transferring the client's care to their office. Before
that could be started, however, Nancy was diagnosed with possible breast cancer.

Unfortunately, Nancy refused to go for a scheduled biopsy. A meeting was called by
the agency to discuss the ethical issues involved and how to proceed. This group
included our solicitor, Anthony DeLuca, as well as our consulting physician Dr.
George Branscum. Because Nancy had requested a second opinion when I met
with her it was decided that we should try to do this. An appointment was made but
she refused to go. However, the doctor did review the mammogram and suggested
we wait for 6 months and then have another mammogram done because the area in
question was very small.
Since then, however, the Home has scheduled an appointment for Nancy to have an
MRI done. Depending on the results of this test, if client cooperates and has the test,
the Office may need to seek a court order to have the required surgery and
treatment done.
It is the request of the Cumberland County Office of Aging that the agency retains
Guardianship of Person for Nancy Hoerner. The South Mountain Restoration Center
has demonstrated an adequate quality of care for his medical and mental problems.
We believe, therefore, that Ms. Hoerner should continue to reside in that nursing
facility .
