FIRST: All of my debts and the expenses of my last illness, funeral and burial shall be paid out of my Estate. SECOND: I devise and bequeath all of my estate of every nature whatsoever and wherever situate, together with all insurance relating thereto, to my husband, Lawrence C. Pierce, Sr, providing he survives me by thirty (30) days. THIRD: Shou 1 d my husband, Lawrence C. Pi eree, Sr, predecease me or die on or before the thirtieth day following my death, I devise and bequeath all of my estate of every nature and wherever situate together with any and all insurance relating thereto, to my children, James C. Pierce, Lawrence C. Pierce, Jr., and Stephen J. Pierce, in equal shares per stirpes, share and share alike, as tenants in common and not as joint tenants. FOURTH: No interest in income or principle shall be assignable by, or available to anyone having a claim against a beneficiary before actual payment to the beneficiary. FIFTH: All federal, state and other death taxes payable because of my death on the property forming my gross estate for tax purposes shall be paid out of the principle of my probate estate just as if they were my debts, and none of those taxes shall be charged against my beneficiaries. SIXTH: I appoint my son, Lawrence C. Pierce, Jr., as Executor of this Will, but if for any reason he fails to qualify or ceases to act, I appoint my son, Stephen J. Pierce, as Executor in his place to carry out the provisions of this Will. I direct that no fiduciary shall be required to give bond.
