COMPLAINT FOR CUSTODY
1. The Plaintiff is Kevin Wells, currently residing at 372 Kerrsville Road, Carlisle,
Cumberland County, Pennsylvania.
2. The Defendant is Lisa Wells, currently residing at either 114 Greenbrook Drive, Marlton,
New Jersey with Respondent's sister (Allyson Browning), or 2118 Greenwood Court, Mt.
Laurel, New Jersey with Respondent's mother.
3. Plaintiff seeks custody of Dylan Wells, (DOB 9/22/98) and Sydney Wells (DOB
7/25/01), currently residing at 114 Greenbrook Drive, Marlton, New Jersey.
4. The children were born during the marriage.
The children are presently in the custody of Lisa Wells, currently residing at 114
Greenbrook Drive, Marlton, New Jersey.
During the past five (5) years, the children have resided with the following persons at the
following addresses:
Kevin and Lisa Wells
Sound Shore Drive, Ocracoke Island, NC 1997 - 12101
Kevin and Lisa Wells
372 Kerrsville Road, Carlisle, PA 12/01 - 6/1/07
The mother of the children is Lisa Wells, currently residing at currently residing at 114
Greenbrook Drive, Marlton, New Jersey. She is married.
The father of the children is Kevin Wells. He is married.
5. The relationship of the Plaintiff to the children is that of father. Plaintiff currently resides
with the following persons: none.
b. The relationship of the Defendant to the children is that of mother. Defendant currently
resides with the following persons: Defendant is believed to be residing with her sister,
brother-in-law, and their two minor daughters, or with her mother.
Plaintiff has participated as a party or witness, or in another capacity, in other litigation
concerning the custody of the child in this or another court, to wit: Plaintiff filed a
Petition for Special Relief contemporaneously with this Complaint for Custody.
Additionally, on June 5, 2007, Defendant filed a Domestic Violence Civil Complaint and
Temporary Restraining Order in Burlington County, New Jersey wherein Defendant
alleged Plaintiff harassed her with text messages and voice mails, granting Defendant
with temporary custody. See attached Exhibit A.
Plaintiff knows of the following persons not a party to the proceedings who have claims
to have custody or visitation rights with respect to the child: none.
The best interest and permanent welfare of the child will be served by granting the relief
requested because Plaintiff is capable of providing for the child's daily physical, social,
emotional, and medical needs, and will ensure the child maintains a close relationship
with Defendant.
9. Each parent whose parental rights to the child have not been terminated and the person
who has physical custody of the child have been named as parties to this action. All other

PETITION FOR SPECIAL RELIEF PURUSANT TO Pa.R.C.P. 1915.13
AND NOW, this l `~' day of June, 2007, comes Plaintiff, Kevin Wells, by and
through his attorneys, Neuharth Law Offices, who avers as follows:
1. The Petitioner is Kevin Wells, Plaintiff father in the above captioned matter. He is
represented by legal counsel, Neuharth Law Offices.
2. The Respondent is Lisa Wells, Defendant mother in the above captioned matter. She is
not represented by legal counsel.
3. The instant parties are the natural parents of two minor children: Dylan Wells, (age 8,
DOB 9/22/98) and Sydney Wells (age S, DOB 7/25/01), who are identified in the
underlying Complaint for Custody.
4. Since 2001, the parties have resided at 372 Kerrsville Road, Carlisle, PA, Cumberland
County.
5. Petitioner believes, and therefore avers, that Respondent is presently residing at either
114 Greenbrook Drive, Marlton, NJ with Respondent's sister (Allyson Browning), or
2118 Greenwood Court, Mt. Laurel, NJ with Respondent's mother.
6. Over the past 6 months, Mother's behavior has become increasingly unstable and
volatile, to wit:
a. One January 3, 2007, the children called Father at work to alert him that Mother
was lying, unresponsive, on the kitchen floor. Following Father's instructions,
the children woke Mother; Mother called the children by the family pets' names.
Father spoke with Mother on the phone and found Mother to be incoherent and
confused.
b. On January 7, 2007, the children called Father at work to alert him that Mother
was acting abnormally. Father arrived home to find Mother locked in the
bedroom, unresponsive. Once Father woke Mother, she appeared confused.
c. On January 18, 2007, Mother called Father at work and stated the children were
45 minutes late coming home from school. Thirty minutes later, Mother called
Father again and told him the children were home. The children told Father they
were home on time, but the doors to the house were locked. After the children
banged on the doors and windows to no avail, they went to a neighbor's home; the
neighbor called Mother several times before Mother answered. Father spoke with
Mother again and noted she was incoherent. Mother told the children to get ready
to go to the store, but Father told the children not to get in the car with Mother.
Mother left in the car alone and called Father again; Mother told Father she had a
flat tire but would try to get home. Approximately one hour later, Pennsylvania
State Police Trooper Rush called Father to alert him that Mother was reported
driving through town with a flat tire. Trooper Rush also stated the car was parked

Jersey PFA was served by the Pennsylvania State Police at 1:30 am on June 6,
2007, at his Pennsylvania residence.
m. On Wednesday, June 6, 2007, Mother was still in New Jersey, and missed her
regularly scheduled Gaudenzia appointment, in violation of her ARD conditions.
7. Petitioner believes that, based upon Respondent's failure to comply with the terms and
conditions of her ARD-directed Gaudenzia treatment, Respondent's resumption of
obtaining mind-altering prescription medications, Respondent's bizarre behavior
removing the children from school without discussing her decision with Petitioner or the
school, and her refusal to allow Petitioner to talk with the children, the minor children's
immediate health and safety will be best served by granting him temporary emergency
physical custody of the minor children, pending the Conciliation Conference and/or a
hearing on the instant Petition.
WHEREFORE, Plaintiff respectfully requests this Honorable Court to enter a temporary
Order immediately ordering Respondent to return the parties' minor children to the jurisdiction.

at 4th Floor, Cumberland County Courthouse, Carlisle on Wednesday, July 18, 2007 at 3:00 PM

AND NOW, this' ~ day of September, 2007, upon consideration of the
attacl~d Custody Conciliation Report, it is ordered and directed that:
1. Legal Custody:: The `Father, .Kevin Wells, shad enjoy primary Legal custody of the
minor children,. Dylan Wells, born 9/22/98 and Sydney Wells, born 7/25/01. The
Father shall have the right to make all major non-emergency decisions affecting
the children's general well=being including, but not limited to, all decisions
regarding their health, education and religion. However, pursuant to the terms of
23 Pa.C:S. §5309, eachparent shall be entitled to all records and information
pertaining to.the children including, but not limited to, medical, dental, religious
or school records, the residence address of the children and of the other parent.
To the. extent one parent has possession of any such records or information, that
parent shall be required to share the same, or copies thereof, with the other parent
within such reasonable time as to make the records and information of reasonable
use to the other- parent.
2. Physical Custody: The Father shall have primary physical custody of Dylan
Wells, born 9/22/98 and Sydney Wells, born 7/25/01 subject to Mother's rights of
supervised. partial physical custody which shall be arranged as the parties may
mutually agree..
3. Mother's supervised physical custody with the Children shall be at Father's
residence or some other mutually agreeable location. Father is responsible for
transporting Children to the agreed upon location and Mother is responsible for
her own. transportation if the supervised visits occur at Father's residence. The
Parents shalL,mutualiy agree upon the supervisor of the visits between Mother and
Children. Mother is directed that she shad not transport Children away from the
designated- supervised custody location.
4. Mother and 1~ ather are directed to not be under the influence of alcohol or illegal
substances while the Children are in their custody.
5. Telephonic and written communication: The non-custodial parent shall have a
right to-have liberal written and telephone contact with the Children. Telephone

contact between Mother and the Children shall be before 9:00 pm.
6. Counseling: `Father shall arrange to have the Children in counseling,
individuaUfamily counseling, with the parents participating upon the
recommendation of the therapist/counselor.
7. Holidays and birthdays shall be mutually agreed upon.
8. Neither party may say or do .anything nor permit a third party to do or say
anything that may estrange the Children from the other party, or injure the opinion
of the Children as to the other party, or may hamper the free and natural
development: of the Children's love or affection for the other party. To the extent
possible, .both parties shall not allow third parties disparage the other parent in the
presence of the Children.
9. This-Order is entered pursuant to a Custody Conciliation Conference. The parties
may modify the provisions: of this Order by mutual consent. In the abse
mutual consent, the terms of this Order shall control. ~~-'~~
