COMPLAINT
1. Plaintiffs Rose Cook and Fazon Cook aze adult individuals and citizens of the
Commonwealth oflPennsylvania who reside in Newville, Cumberland County, Pennsylvania.
2. Defendant Jennifer Hall is an adult individual and citizen of the Commonwealth
of Pennsylvania, who resides at 5 Hickory Road, Cazlisle, Cumberland County, Pennsylvania,
17013.
3. Thei facts and occurrences hereinafter related took place on or about October 28,
2005, at approximately 6:25a.m., at the intersection of College Street and High Street in Cazlisle,
Cumberland Count, Pennsylvania.
4. At that time and place, Plaintiff Rose Cook was operating a 1998 Ford stopped at
a red stop light east on High Street.
5. At that same time, Defendant Jennifer Hall was operating a 2000 Ford traveling
west on High Streek.
6. Def~ndant Jennifer Hall failed to stop for the red light at the intersection of High
Street and College Street.

7. DavXd Wirrick was driving a van owned by Bayment Electric, Inc., on College
Street, and the vary struck Defendant Hall's vehicle as Mr. Wirrick proceeded through a green
light in the subject intersection.
8. Def~ndant Hall's vehicle then collided into Mrs. Cook's stationary vehicle.
9. Mrs} Cook's vehicle was then pushed backwazds into Richazd Gilbert's 1986
Chevrolet by the fo~ce of the impact.
10. The I, foregoing accident and all of the injuries and damages set forth hereinafter
sustained by Plaint~ff Rose Cook aze the direct and proximate result of the negligent, careless,
wanton and reckless manner in which Defendant Jennifer Hall operated her motor vehicle as
follows: I'
a) Failure to stop at a red light;
b) i~ailure to apply her brakes in sufficient time to avoid striking any vehicles;
c) $'ailure to travel at a safe speed;
d) Failure to keep proper and adequate control over her vehicle; and
e) driving her vehicle upon the highway in a manner endangering persons and
property an m a reckless manner with careless disregard to the rights and safety of others
and in viola,'on of the Motor Vehicle Code of the Commonwealth of Pennsylvania.
CLAIM I

11. Paragraphs 1 through 10 of the Complaint are incorporated herein by reference as
if set forth at length.
12. Plai tiff Rose Cook sustained painful injuries which include but are not limited to
bilateral neck pain, 'ght shoulder pain, and back pain.

13. By ~eason of the aforesaid injuries sustained by Plaintiff Rose Cook, she was forced
to incur liability for medical treatment, medications, and similar miscellaneous expenses in an effort
to restore herself to Ihealth, and claim is made therefor.
14. Bec~use of the nature of her injuries, Plaintiff Rose Cook has been advised and,
therefore, avers that she may be forced to incur similar expenses in the future, and claim is made
therefor.
15. As ~ result of the aforementioned injuries, Plaintiff Rose Cook has undergone and in
the future may un~ergo physical and mental suffering, inconvenience in carrying out her daily
activities, loss of li f e's pleasures and enjoyment, and claim is made therefor.
16. As ~ result of the aforementioned injuries, Plaintiff Rose Cook has sustained work
loss, loss of opport~xnity, and impairment of earning power, and claim is made therefor.
17. Plai~tiff Rose Cook continues to be plagued by persistent pain and limitation and,
therefore, avers that her injuries may be of a permanent nature, causing residual problems for the
remainder of her lif~time, and claim is made therefor.

19. As ~ result of the aforementioned injuries sustained by his wife, Plaintiff Faron Cook
has been and may 'i~ the future be deprived of the care, companionship, consortium, and society of
his wife, all
will be to his great detriment, and claim is made therefor.

WHEREFORE, Plaintiffs Rose Cook and Fazon Cook demand judgment against Defendant
Jennifer Hall in an Il~~amount in excess of Fifty Thousand Dollars ($50,000.00), exclusive of interest
and costs and in excess of any jurisdictional amount requiring compulsory azbitration.
