HomeMy WebLinkAbout03-3917STIPULATION AGAINST LIENS THIS AGREEMENT made the by and between "Q" Specialty Services , day of/~/, 2003 hereinafter referred to as Contractor, Michael C. Lovejoy, hereinafter referred to as Owner, whereby the former undertook and agreed to construct a single family dwelling, in SOUTH MIDDLETON TOWNSHIP , Cumberland County, Pennsylvania. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of One Dollar to it in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties ac~ing through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Signed, Sealed and Delivered in the presence of "Q" Specialty Services ~h'ris Jones/ (SEAL) (SEAL) A~LL THAT CERTAIN tract of land situate in South Middleton Township, Cumberland County, Pennsylvania, more particularly bounded and described according to a survey by Jerry D. LaRue, R.S., dated November 11, 1986, as follows: BEGINNING at an iron bar in a stone pile at corner of land now or formerly of Old Town Run Mountain Lodge, Gardner, and the within tract; thence by land now or formerly of Gardner, South 18 degrees 08 minutes 19 seconds East, 440.39 feet to an iron stake in a stone pile; thence by land now or formerly of Trimmer, South 19 degrees 23 minutes 20 seconds East, 241.60 feet to an iron pipe in a stone pile; thence by land now or formerly of Wilson, South 20 degrees 01 minute 58 seconds East, 331.16 feet to an iron pin; thence by land now or formerly of A. Gardner the following courses and distances: (1) North 77 degrees 20 minutes 58 seconds West, 119.12 feet to a pipe; (2) North 81 degrees 48 minutes 45 seconds West, 159.92 feet to a pipe; (3) North 54 degrees 56 minutes 17 seconds West, 85.74 feet to a pipe; (4) North 86 degrees 15 minutes 07 seconds West, 222.46 feet to a pipe; (5) North 82 degrees 19 minutes 00 seconds West, 191.36 feet to a pipe; (6) North 71 degrees 44 minutes 57 seconds West, 427.10 feet to an iron pin at the junction of the mountain roads; thence by land now or formerly of Old Town Run Mountain Lodge the following courses and distances: (1) North 31 degrees 18 minutes 11 seconds East, 223.35 feet to an iron pin; (2) North 46 degrees 53 minutes 42 seconds East, 493.71 feet to an iron pin; (3)North 66 degrees 56 minutes 06 seconds East, 160.06 feet to an iron pin; (4) North 51 degrees 14 minutes 20 seconds East, 101.37 feet to an iron pin; (5) North 76 degrees 22 minutes 02 seconds East, 132.11 feet to an iron bar in a stone pile, the point and place of BEGINNING. CONTAINING 13.675 acres. BEING the same premises which C. Edgar Moose and L. Kathryn Moose, husband and wife, by their deed dated December 17, 1986, and recorded December 22, 1986, in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book J, Volume 32, Page 853, granted and conveyed unto George W. Lovejoy, Grantor herein. TOGETHER with the right to use in common with the Grantor, his heirs -~ and assigns, a right-of-way of a width of 20 feet extending in a ~ generally East and West direction as now marked by the Appalachian Trail for ingress and egress from the above-described tract to the Old Town Road. EXCEPTING ~ RESERVING unto the Grantor, his heirs and assigns, a right-of-way of a width of 20 feet extending in a generally east and west direction along the easternmost boundary of the property herein conveyed for purposes of ingress and egress to other lands of Grantor consisting of approximately 5.34 acres of land conveyed to the Grantor by Robert Dill Gardner and Linda L. Gardner, his wife, by deed dated March 16, 1990, and recorded March 27, 1990, in Cumberland County Deed Book M, Volume 34, Page 5. UNDER ~ SUBJECT, HOWEVER, to the rights of others to an easement or right-of-way 20 feet in width and extending in a southwesterly direction along the northwestern property line of the premises herein conveyed leading to the Old Town Road.
