Shippensburg, Pennsylvania, hereinafter referred to ontractor, BIZ ` y 6
AND
STEVENL. WISE and ALISONL. WISE, of Shippensburg, Pennsylvania, hereinafter referred to
as Owner,
WHEREAS, the said Contractor undertook and agreed to make certain improvements to
Owner's property situate in Cumberland County, Pennsylvania, known as Lot 2 and Lot lA Strohm
Hollow Road, Shippensburg, Southampton Township, Cumberland County, Pennsylvania, more
fully described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of One Dollar ($1.00) to said Contractor in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement
aforesaid, for himself, and his subcontractors, and all parties acting through or under them, covenant
and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and improvements and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said improvements on the lot
above described, and the said Contractor, for himself, his subcontractors and others under him
hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or
claims against the said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

ALL that certain tract of land situate in Southampton Township, Cumberland County, Pennsylvania,
more fully bounded and described as follows:
BEGINNING on line of land belonging formerly to George Middlecoffs, now or formerly S. K.
Clever, near a public road leading from Leesburg to Strohm's sawmill; thence by same South twenty-
five (25) degrees East forty and six tenths (40.6) perches to a stone; thence by lands formerly of John
Grove, now or formerly of Henry Beattie, North fifty-one (51) degrees East seventy-four and two
tenths (74.2) perches to a stone; thence by land formerly of John R. Hoch, now or formerly of Joseph
Clever, North twenty-five (25) degrees West two (2) perches to stone; thence by land formerly of H.
B. Hoch, now or formerly of D. Allen, South eighty (80) degrees West seventy-five (75) perches to
the place of Beginning. Containing 9 Acres and 85 Perches, net.
BEING the same real estate which Richard R. Ulsh and Virginia C. Ulsh, by deed dated December
20, 2000, and recorded January 10, 2001, in Cumberland County Deed Book 237, Page 666, granted
and conveyed to Steven Lee Wise and Alison L. Wise, Mortgagors herein.

ALL that certain tract of real estate lying and being situate in Southampton Township, Cumberland
County, Pennsylvania, more fully bounded and described as follows:
BEGINNING at a set iron pin at the corner of lands now or formerly of Wayne Hershey, Sr., and
Flossie Hershey and lands now or formerly of Donald L. Stine and Florence A. Stine, Grantors
herein; thence by lands now or formerly of Stine, South 71 degrees 31 minutes 43 seconds West,
69.00 feet to a set iron pin; thence along the same, North 18 degrees 28 minutes 17 seconds West,
103.00 feet to set iron pin; thence along the same, North 71 degrees 31 minutes 43 seconds East,
69.00 feet to a set iron pin, at the corner of lands now or formerly of Steven L. Wise and Alison L.
Wise, Grantees herein; thence along lands now or formerly of Wise, South 18 degrees 28 minutes 17
seconds East, 59.62 feet to an iron pin at a common corner of lands now or formerly of Steven L.
Wise and Alison L. Wise, Donald L. and Florence A. Stine, and Wayne Hershey, Sr., and F lossie
Hershey; thence along lands now or formerly of Hershey, South 18 degrees 28 minutes 17 seconds
East, 43.38 feet to a set iron pin, the point and place of BEGINNING.
BEING LOT No. lA on a Subdivision Plan entitled Final Minor Subdivision Plan for Donald Land
Florence A. Stine, prepared by Burget and Associates, Inc., and dated January 11, 2007, and
recorded in Cumberland County Plan Book 93, at Page 112.
ALSO BEING the same real estate which Donald L. Stine and Florence A. Stine, by deed dated
March 2, 2007, and recorded March 8, 2007, in Cumberland County Deed Book 279, Page 312,
granted and conveyed to Steven L. Wise and Alison L. Wise, Mortgagors herein.
