THIS AGREEMENT made this ~ day 2Q07, by and between
D. CULlY, INC., D/B/A C & C CONSTR ~I'ION, Pe s vania Corporaflon,
hereinaffer referred to as Gontractar,
AND
TIMQTHY M. SIWY and INGRII~ J. SIWY, husband and wife hereinaffer referred to
as Owner, whereby the contractor undertook and agreed to erected and
construct a dwelling on the certain lot of ground situate in West Pennsboro
Township, Cumberland County, Commonwealth of Pennsylvania, known as Lot
5,4 Greystone Acres Pennway Circle, Carlisle, PA 17015.
NOW THERE~4RB, THIS AGREEMENT WITNESSETH: That the said Contractor,
far an in consideratian of the sum of ($1,00) Dollar to Contractor in hand paid by
Owner, the receipt whereof is hereby acknowledged, and the further
consideration mentioned in the agreement aforesaid, for itself, himself or
themselves and its, his or their subcontractors, and a!I parties aching through or
under them, covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the staid buildings and the lot
of ground appurtenant thereto for or on accounfi of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards,
in, or about the erection and construction of the said buildings on the lot above
described, and the said Contractor, for itself, himself or themselves, its, his or their
subcontractors and others under them, hereby expressly waive and relinciuish
the right to have, file, and maintain any mechanic's liens Qr claims against the
said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant,

ALL THAT CERTAIN TRACT of land situate in West Pennsboro Township, Cumberland
County, Pennsylvania, bounded and described in accordance with Final Subdivision Plan
for Greystone Acres consisting of nine (9) sheets prepared by Louis J. Harford, Registered
Surveyor, dated June 14, 1996, a copy of which was recorded in the hereinafter named
Recorder's Office in Plan Book 72, Page 70, which Plan is incorporated herein by reference,
as follows:
BEGINNING at a point on the southws Nos. 54 and 55nthence ffrom sated point at the place
60 feet at the dividing line between Lot
of beginning along line of said Pennway Circle by a curve to the left an arc distance of 81.57
feet to a point; thence still along line of said Pennway Circle, North 59 degrees 02 minutes
08 seconds East a distance of 54.73 feet to a point at the dividing line between Lots Nos. 53
and 54; thence along said dividing line between said Lots Nos. 53 and 54; South 30 degrees
57 minutes 56 seconds East a distance of 400.43 feet to a point on the northern line of Lot
No. 49; thence along a portion of the northern line of said Lot No. 49 and continuing along
the northern line of Lot No. 48, North 77 degrees OS minutes 46 seconds West a distance of
526.22 feet to a point at corner common to Lots Nos. 47 and 48 and 54 and 55; thence along
the dividing line between said Lots Nos. 54 and 55 the following two courses in distances:
(1) North 12 degrees 54 minutes 15 seconds East a distance of 46.70 feet to a point; and (2)
North 46 degrees 55 minutes 30 seconds East a distance of 238.39 feet to a point on the
southwestern line of said Pennway Circle at the place of BEGINNING.
THE ABOVE described tract of land is all of Lot No. 54 as shown on said final subdivision
plan for Greystone Acres, recorded in Plan Book 72, Page 70.
