Fair, through her attorney, Thomas S. Diehl, makes the following Complaint in Divorce, and, in support thereof, avers as follows: 1. The Plaintiff, Barbara L. Fair, is an adult individual who currently resides at 12 Matthew Court, Carlisle, Cumberland County, Pennsylvania 17013. 2. The Defendant, Richard A. Fair, is an adult individual who currently resides at 12 Matthew Court, Carlisle, Cumberland County, Pennsylvania 17013. 3. The Defendant and the Plaintiff have been bona fide residents of the Commonwealth of Pennsylvania for at least six months immediately prior to the filing of this Complaint. 4. Westminster, Maryland. 5. 6. America or its Allies. The Plaintiff and the Defendant were married on October 23, 1989 in There have been no prior actions of divorce or for annulment between the parties. The Defendant is not a member of the Armed Forces of the United States of 7. The Plaintiff has been advised of the availability of counseling and the right to request that the Court require the parties to participate in counseling. Knowing this, Plaintiff does not desire that the Court require the parties to participate in counseling. 8. Plaintiff and Defendant are citizens of the United States of America. 9. The Plaintiff, Barbara L. Fair, (hereinafter "Wife") brings this action against defendant, Richard A. Fair (hereinafter "Husband") and complains and says: 2. That the Parties are husband and wife, having been married on October 23, 1989. C 3. That Wife filed for divorce contemporaneously with filing this petition. ~1 : 4. That Husband has a retirement from the Commonwealth of Perms*~ ' yanm, State employees' Retirement system (hereinafter "SERS"). A statement of this account is attached as "Exhibit B". 6. That the tv~o above referenced accounts constitute the bulk of the Parties marital assets. 7. That Husband has stated to Wife on numerous occasions that he would ensure that she would not receive any· of his retirement accounts regardless of their status under the law. 8. Wife believes and therefore avers that Husband would be willing to dissipate or convert his retirement accounts in order to prevent them from becoming subject to equitable distribution. 9. Pursuant to 23 Pa.C.S.A. Section 3505(a), where it appears to the court that a party is about to dispose of property, in order to defeat equitable distribution, an injunction may be issued to prevent the removal or disposition and the property may be attached as prescribed in general rules. I 0. That Wife shall be irreparable harmed financially should Husband dissipate said assets.
