The Plaintiff, Barbara L. Fair, through her attorney, Thomas S. Diehl, makes the
following Complaint in Divorce, and, in support thereof, avers as follows:
1. The Plaintiff, Barbara L. Fair, is an adult individual who currently resides at 12
Matthew Court, Carlisle, Cumberland County, Pennsylvania 17013.
2. The Defendant, Richard A. Fair, is an adult individual who currently resides at 12
Matthew Court, Carlisle, Cumberland County, Pennsylvania 17013.
3. The Defendant and the Plaintiff have been bona fide residents of the
Commonwealth of Pennsylvania for at least six months immediately prior to the filing of this
Complaint.

to enter a decree in divorce pursuant to 23 P.S. § 3301(c) or 3301(d) of the Divorce Code.

PETITION TO ENJOIN THE WITHDRAWAL OF RETIREMENT FUNDS UNDER
SECTION 3505 OF THE DIVORCE CODE
To the Honorable Judges of this Court:
1. The Plaintiff, Barbara L. Fair, (hereinafter "Wife") brings this action against defendant,
Richard A. Fair (hereinafter "Husband") and complains and says:
2. That the Parties are husband and wife, having been married on October 23, 1989.

3. That Wife filed for divorce contemporaneously with filing this petition. ~1 :
4. That Husband has a retirement from the Commonwealth of Perms*~ '

employees' Retirement system (hereinafter "SERS"). A statement of this retireme'fi~.~ccount isl

5. That Husband has a second investment account held through American Funds. A
statement of this account is attached as "Exhibit B".
6. That the tv~o above referenced accounts constitute the bulk of the Parties marital assets.
7. That Husband has stated to Wife on numerous occasions that he would ensure that she
would not receive any· of his retirement accounts regardless of their status under the law.
8. Wife believes and therefore avers that Husband would be willing to dissipate or convert
his retirement accounts in order to prevent them from becoming subject to equitable distribution.
9. Pursuant to 23 Pa.C.S.A. Section 3505(a), where it appears to the court that a party is
about to dispose of property, in order to defeat equitable distribution, an injunction may be issued
to prevent the removal or disposition and the property may be attached as prescribed in general
rules.
I 0. That Wife shall be irreparable harmed financially should Husband dissipate said assets.
WHEREFORE, Plaintiffprays this honorable court to:
a) Enjoin Husband from withdrawing, assigning, alienating
ownership of the funds from his SERS and American Funds accounts; AND
b)
or transferring
Any such other and further relief the Court may deem to be appropriate.

within Complaint to enjoin the withdrawal of retirement funds, it is ordered and decreed that
without leave of this Court,
I. Richard A. Fair shall not withdraw, assign, alienate or transfer ownership of his
funds from his retirement fund with the Commonwealth of Pennsylvania State Employees'
Retirement System, held under social security number 185-34-3349.
2. He shall not withdraw, assign, alienate or transfer ownership of his funds from his
accounts held with American Funds P.O. Box 2280, Norfolk, VA 23501. This specifically
includes but is not limited to the following accounts numbered:
