PETITION FOR WAIVER OF THREE DAY WAITING PERIOD
FOR MARRIAGE LICENSE
1. Petitioner is an active duty member of the United States Army.
2. Petitioner has his legal residence in Pennsylvania.
3. Petitioner and his current wife, Helena Marie Gerard, are parties to a divorce action
pending in the Court of Common Pleas of Cumberland County, Pennsylvania docketed to No. 07-
1471.
4. The parties to the divorce will be able to file consents on June 26, 2007 and intend
to do so.
5. Petitioner has military orders for a multi-year overseas assignment for which he will
be leaving July 4,2007.
6. Petitioner desires to remarry prior to his deployment.
7. 23 Pa.C.S.A. ~ 1303(b) authorizes the Orphans' Court to waive the three day waiting
period for the marriage license to be valid upon good cause shown, including if an applicant is a
member ofthe U.S. armed forces and is called or ordered to active duty.

WHEREFORE, Petitioner prays your honorable court to find the above to be good and
sufficient cause and to issue the attached order waiving the three day waiting period to allow
petitioner to marry prior to his military deployment overseas.
