COMPLAINT - CIVIL ACTION
1. Plaintiff, CHRISTOPHER JOZWIAK, is an adult individual and resident of the
Commonwealth of Pennsylvania residing therein at 79 Chesapeake Estates, Thomasville,
Pennsylvania 17364.
2. Defendant, MELINDA BLANKENSHIP, is an adult individual and resident of
the Commonwealth of Pennsylvania residing therein at 110 N. Market Street, Mechanicsburg,
Pennsylvania 17055.
3. All events mentioned herein occurred on or about June 24, 2005 at approximately
6:53 p.m.
4. On or about June 24, 2005, Plaintiff, Christopher Jozwiak, was operating a motor
vehicle on southbound in the 6500 block of Carlisle Pike in the area of 6525 Carlisle Pike in
Reading Township, Adams County, Pennsylvania.
5. On or about June 24, 2005, Plaintiff, Christopher Jozwiak was stopped in the
southbound lane on Carlisle Pike with his left signal activated.
6. On the same date and time, Defendant, Melinda Blankenship was operating a
motor vehicle traveling southbound in the area of 6525 Carlisle Pike in Reading Township when
the vehicle she was operating failed to stop and struck the rear of Plaintiff's vehicle.
7. The collision resulted solely from the negligence, carelessness and recklessness of
the Defendant, Melinda Blankenship, and was due in no manner whatsoever to any act or failure
to act on the part of the Plaintiff.
8. The Plaintiff, Christopher Jozwiak, was acting with due care under the
circumstances at all times.

9. As a result of defendant's negligence, Christopher Jozwiak sustained severe,
disabling and painful personal injuries consisting of.
a. Physical injuries to various parts of his body, including but limited to,
a concussion, low back pain, neck pain, headaches, blurry vision, dizziness, chronic
cervical strain, right sided bicep pain, atrophy of the right thigh, internal derangement of
the right knee, necessitating right knee surgery; and other injuries, the full extent of
which are not yet known; some or all of which may be permanent in nature;
b. Great pain, suffering and loss of enjoyment of life's pleasures, past and
future;
C. Hospital, medical and rehabilitative expenses, past and future;
d. Loss of earnings and earning capacity.
10. As a result of his injuries, Plaintiff Christopher Jozwiak, may hereinafter incur
medical expenses and income losses that exceed sums recoverable under 75
Pa.C.S.A. § 1711.
11. At the time of the aforementioned accident, Plaintiff's insurance policy provided
for Limited Tort Benefits. However, since this accident resulted in severe and permanent
injuries of the driver resulting in serious impairment of body function, Full Tort Benefits are
applicable. See attached copy of the declarations page marked Exhibit "A" in effect at the time
of the accident.

COUNT I - NEGLIGENCE
12. Plaintiff realleges and incorporates by reference each and every preceding
paragraph as though set forth fully at length.
13. The negligence and carelessness of Defendant consisted of the following acts and
omissions:
a. Failure to properly operate and control a motor vehicle under the
circumstances;
b. Driving at an excessive and unsafe rate of speed under the circumstances;
C. Operating a motor vehicle in a reckless manner without due regard for the
rights and safety of those lawfully upon the highway, one of which was the Plaintiff,
d. Failing to keep a reasonable look-out for other vehicles lawfully on the
road;
e. Failing to observe and obey the posted speed limit;
f. Operating a motor vehicle in a careless, reckless and negligent manner in
violation of the Motor Vehicle Code of the Commonwealth of Pennsylvania and the Rules of the
Road as set forth in 75 Pa. C.S.A. 3102 et. Seq
g. Failing to drive at a speed and in a manner that would allow her to stop
within the assured clear distance ahead;
h. Failure to properly service, repair, and maintain the motor vehicle in safe
working order;
i. Negligence at law and in fact as will be further revealed through
discovery.
WHEREFORE, Plaintiff, CHRISTOPHER JOZWIAK, demands compensatory

damages against the Defendant, MELINDA BLANKENSHIP, in a sum in excess of Fifty
Thousand ($50,000.00) Dollars plus costs, interest, and such other relief as the Court deems
just and proper.

information that I have furnished to my counsel and information that has been gathered by my
counsel in preparation of my lawsuit. The language of the Complaint is that of counsel and not of
me. I have read the Complaint and to the extent that the Complaint is based upon information that I
have given to my counsel, it is true and correct to the best of my knowledge, information and belief.
To the extent that the content of the Complaint is that of counsel, I have relied upon counsel in
making this Verification. I hereby acknowledge that the facts set forth in the aforesaid Complaint
are made subject to the penalties of 18 Pa.C.S. §4904 relating to unsworn falsification to authorities.
