r STIPULATION WAIVER OF RIGHT TO FILE LIEN
' WHEREAS, Wohlsen Construction Company (hereinafter "CONTRACTOR"), having an
office at 548 Steel Way, Lancaster, PA 17601, has entered into a contract dated May 25, 2007
with Pennsylvania-American Water Company (hereinafter "OWNER"), having an office at 800
West Hershey Park Drive, Hershey, PA 17033, to provide materials and equipment and to
perform labor necessary for the construction of the Project entitled "Hershey & Mechanicsburg
Office Reconfiguration" situated in Lower Allen Township, Cumberland County,
1 Pennsylvania, and located at 852 Wesley Drive, Mechanicsburg, PA 17055.
NOW THEREFORE it is hereb sti ulated and a eed b and between the said arties

' as part of the said contract and for the consideration therein set forth, that neither the undersigned
CONTRACTOR, any subcontractor or material-man, nor any other person furnishing labor or
materials to the said CONTRACTOR under this contract shall file a lien, commonly called a
mechanic's lien, for work done or materials and equipment furnished to the said Project or any
' part thereof.
This stipulation is made and intended to be filed with the Cumberland County
Prothonotary within ten days after the date hereof, in accordance with the requirements of Act of
Assembly of Pennsylvania, in such case provided.
