TFXxS AGREEMENT made the ~~ day of June, 2007, by and
Y~etw~:en STRICKI~ANv BROTHERS CONSTRUCTION, LLC, of 623 Creek Road,
Carlisle, I~ennsylvania 17013, hereinafter referred to as
Contractor, AND THOMAS S. STEWART and CORRINE L. STEWART, of 1959
WaggoTiers Gap Road, Carlisle, Pennsylvania 17013, hereinafter
reL•errc:d to as Owner, whereby the formex undertook and agreed to
erect and construct a ,;ingle~family residential dwelling on that
certain lot of ground situate on 1321 Enola Road, in North
Middleton Township, Cumberlandt County, Pennsylvania, be~.ng
descxibcd in accordance with a survey dated June 27., 2006, as
prepared by Eric L. Diffenbaugh. Being the same premises which
Thomas N. Stewart and Betty J. Stewart by Deed dated February 20,
7007 and recorded February 20, 2007 in the Cumberland County
Recordor of Deeds Office in Deed Book 278, Page 4079, granted and
conveyed unto Thomas S. Stewart and Corrine L. Stewart, husband
dnd wife .
NOW TI~REFORE, THIS AGREEMENT W'Y'1'NESSETH: That the said
Contractor, for and in consideration of the sum of One t$1.00)
i7ol.lar Lo it in hand paid by Owner, the receipt- whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and
all. parties acting through or undex them, covenant and agree that
no mechanic's liens or claa~ms shall be filed or maintained by
them or any o£ them against the said buildings and the lot of
ground appurtenant thereto tox' or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
conutruction of the s<3id buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby express~.y waive and relinquish the right
to have, £ile, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.
