STIPULATION WAIVER OF RIGHT TO FILE LIEN
WHEREAS, Kens Plumbing, Inc., (hereinafter "CONTRACTOR"), having an
office at 260 Old York Road, New Cumberland PA, 17070, has entered into a
contract dated May 25, 2007 with Pennsylvania-American Water Company (hereinafter
"OWNER"), having an office at S00 West Hershey Park Drive, Hershey, PA 17033, to provide
materials and equipment and to perform labor necessary for the construction of the Project
entitled "West Shore PRV'S "situated in Wormleysburg Borough, Cumberland County,
Pennsylvania.
NOW, THEREFORE it is hereby stipulated and agreed by and between the said parties, as
part of the said contract and for the consideration therein set forth, that neither the undersigned
CONTRACTOR, any subcontractor or material-man, nor any other person furnishing labor or
materials to the said CONTRACTOR under this contract shall file a lien, commonly called a
mechanic's lien, for work done or materials and equipment furnished to the said Project or any part
thereof.
This stipulation is made and intended to be filed with the Cumberland County Prothonotary
within ten days after the date hereof, in accordance with the requirements of Act of Assembly of
Pennsylvania, in such case provided.
