The Plaintiff, ENVIRONMENTAL SYSTEMS PRODUCTS, INC., by its attorneys,
KODAK 8~ IMBLUM, P.C., brings this action of Assumpsit against the Defendants to
recover the sum of FOUR THOUSAND TWO HUNDRED EIGHTY-TWO DOLLARS AND
NINETY-TWO CENTS ($4,282.92), along with interest thereon at the statutory rate from
January 3, 2004, upon a cause of action of which the following is a statement:
1. The Plaintiff, ENVIRONMENTAL SYSTEMS PRODUCTS, INC., is a corporation
organized and existing under the laws of the State of Connecticut, having its
principal office and place of business at 7 Kripes Road, E. Granby, CT 06026.
2. The Defendant, ROBERT MINTER, is an adult individual with an address of 409 A
Street, Carlisle, Cumberland County, Pennsylvania 17013.
3. The Defendant, ROBERT MINTER, trading and doing business as MINTER'S
GARAGE, a sole proprietorship, has an office and place of business at 409 A
Street, Carlisle, Cumberland County, Pennsylvania 17013.

4. On or about November 2003, Defendants submitted a Credit Application to Plaintiff
for the lease of new smog equipment for Defendants' business, a true and correct
copy of which is attached hereto, marked Exhibit "A" and made a part hereof.
5. On or about November 25, 2003, Defendants entered into a Sales Agreement with
Plaintiff for the lease of said smog equipment, a true and correct copy of which is
attached hereto, marked Exhibit "B" and made a part hereof.
6. Thereafter, on November 25, 2003, the parties entered into a written Lease
Agreement, Lease Number 40114234, whereby Defendants would make payments
to Plaintiff for a term of twenty-four (24) months on said smog equipment, a true and
correct copy of which is attached hereto, marked Exhibit "C" and made a part
hereof.
7. On or about December 9, 2003, said equipment was delivered by Plaintiff to
Defendants, receipt of which was acknowledged by Defendants as set forth on the
signed Delivery and Acceptance Certificate attached hereto, marked Exhibit "D"
and made a part hereof.
8. The price charged for said equipment was just and reasonable, was the legal and
market prices therefor and was the price which the Defendants contractually
promised and agreed to pay to Plaintiff.

9. The balance due and owing by Defendants to Plaintiff under the Lease Agreement is the
sum of Three Thousand Five Hundred Sixty-Nine Dollars and Ten Cents ($3,569.10), as
appears by Plaintiff's Statement of Account hereto attached, marked as Exhibit "E" and
made a part hereof.
10. Due to the default of Defendants and pursuant to the terms and conditions of the Lease
Agreement executed by Defendants hereto attached as Exhibit "C", attorney's fees in the
total amount of Seven Hundred Thirteen Dollars and Eighty-Two Cents ($713.82) have
been added to said account.
11. Plaintiffs Invoices are not attached to this pleading due to the voluminous nature of same
and have previously been provided to Defendants.
12. Plaintiff frequently demanded payment from Defendants of said amount due and owing as
aforesaid, but Defendants refused and neglected and still refuse and neglect to pay said
amount or any part thereof.
WHEREFORE, Plaintiff brings this suit to recover from Defendants the sum of FOUR
THOUSAND TWO HUNDRED EIGHTY-TWO DOLLARS AND NINETY-TWO CENTS ($4,282.92),
along with interest thereon at the statutory rate as set forth herein.
