Plaintiff, DISCOVER BANK , is a DELAWARE STATE BANK authorized to do business in the Commonwealth of Pennsylvania with its place of business at 6500 NEW ALBANY ROAD, NEW ALBANY, OH 43054. 2. The Defendant(s), SINN PHAN TRANPHON , resides at 219 S 18TH ST APT 1 CAMP HILL, PA 17011-5514. 3. There is due from the Defendant(s) the sum of $9,980.16 for credit extended by Plaintiff to Defendant(s), acct. no. ************0322, and which such credit was drawn and used by the Defendant(s). Defendant(s) is in default for failure to make payments for such use. 4. ADMITTED in part, DENIED in part. It is admitted that Plaintiff Discover Bank may be a proper plaintiff however it is not known that whether Discover Bank is a Delaware state bank. Strict proof of this portion of this paragraph is demanded at time of trial. Further, it is not known as to whether or not 6500 New Albany Road in New Albany, OH 43054 is the actual and truthful address for the Plaintiff. Defendant requests strict proof of this allegation at time of trial. 2. ADMITTED 3. DENIED. The Defendant denies exercising a Discover Bank card that incurred a debt in the actual amount of $9,980.16. It is believed by the Defendant that the actual debt is far less than $9,980.16. The excessive claim or charge must be strictly proven at the time of trial. It is believed that the ' claim is loaded with interest and penalty which may be a violation of Defendant's rights and in violation of the various consumer laws such as the Truth in Lending Law both federal and state. 4. ADMITTED in part, DENIED in part. It is admitted that the Plaintiff has requested a payment of $9,980.16, however the Plaintiff did not support or justify this request. The Defendant believes that at all times pertinent and relevant herein that this claim for $9980.16 is improper, incorrect, inappropriate, and represents add on penalties, interest and charges which t,.: ; may be unlawful. Further, the Defendant demands strict proof of the actual amount of debt incurred on this particular claim or account. 5. DENIED. Although reference is made in Paragraph 5 of an application of various credits to the account owned by the Defendants, there has not been an attachment to the complaint itself showing a copy of various credits which may have been made. The Defendant alleges that credits have not been applied as required by law to this account. Furthermore, Defendant alleges that all documents that goes to the basis of this claim have not been attached to the complaint as required and defendant demands strict proof of this debt at time of trial.
