GOODLING dayof ~-x¢~$~" , I~200~, hereinafter referred to as Contractor, AND KIERNA BLACK, Owner, whereby the former undertook and agreed to erect and construct a , hereinafter referred to as SINGLE FAMILY DWELLING HOUSE onthatcerta~lotofgroundsituateia in the Township of Upper Allen, Cumberland County, Pennsylvania, more particularly known as Lot No. 56, Phase VIII, as shown on Final Subdivision Plan of Meadow~view Estates as recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 74, Page 108, and as more fully described in a deed dated January 28, 1998, from John M. Knaub to Samuel A. and Kierna Black, husband and wife, recorded on February 2, 1998, in the Recorder's Office aforesaid in Deed Book 171, Page 557, and incorporated herein by reference thereto. (The said Samuel A. Black died on May 8, 2001, survived by his wife, Kierna Black, the "Owner" herein, in whom title vested absolutely by operation of law as surviving tenant by the entireties. NOIV THEREFORe, THIS `4GREEMENT ~/ITNESSETH: That the said Contractor, for and in consideration of the sum of($I.00) Dollar to him in hand paid by Owner, the receipt whereof is hereby acknowledged, and the .further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any n~qqhanic's liens or claims against the said buildings or any of them, ar~d agree that this instrument, waiving the r4ght of lien, shall be an independent covenant.
