Township of Hampden ("Claimant") files this Municipal Claim against David T. Jacobs
and all that certain tract of land including improvements thereon, owned by the

unpaid tapping fees which were charged effective May 24, 2007 pursuant to Hampden
ownship Code of Ordinances and the tapping fee assessment agreement of the Owner attached
and incorporated herein as "Exhibit A".
Exhibit A attached hereto is a statement of the kind and character of the services so
and the prices charged therefor, said statement being a true and correct copy of the
agreement and account with the Claimant, which sum of $5,200.00 was duly assessed
the above Owner and premises beginning May 24, 2007 and for which sum, including
interest, costs and attorney's fees, a lien is claimed against the above premises in accordance
the Municipal Authorities Act of June 19, 2001, P.L. 287, 53 P.S. § 5601, et sea, as

AGREEMENT
THIS AGREEMENT is made and entered into between David T. Jacobs of 4460 Valley
Road, Enola, Penns}rlvania ("Jacobs") and Hampden Township, having an address of 230 South
Sporting Hill Road, Mechanicsburg, Pennsylvania (the "Township").
In consideration of the mutual covenants and promises made by the parties hereto and
intending to be legally bound hereby the parties agree as follows:
1. Jacobs hereby covenants and agrees to a municipal claim and lien being filed against
him and his property at 4460 Valley Road, Enola, Pennsylvania (the "Property') in the amount of
$5,200.00, which anlount represents the tapping fee for sewer service available to the Property
for one EDU.
2. Jacobs acknowledges and agrees to pay the sum of $5,200.00 to Townslup upon sale
of the Property, which sale Jacobs anticipates occumng within two years of May 24, 2007.
Tcwnship agrees that it will not execute on the municipal lien within two years of May 24, 2007;
however, the parties agree that in the event the Property is not sold and the Township paid
$5,200.00 within two years of May 24, 2007 or, Jacobs has not otherwise paid the tapping fee of
$5,200.00 within that two year period, Township may at its election at any time after May 24,
2009 execute on the municipal lien entered on the Property and compel Jacobs or the other
present owner(s) of the Property to connect to the sanitary sewer line serving the Property.
3. Jacobs acknowledges that Tovui~ship has billed and will continue to bill Jacobs sewer
rental fees, which fees are separate from the tapping fee described above to be paid by Jacobs.
4. This Agreement shall constitute a covenant running with the Property of Jacobs and
any improvements thereon and. shall be binding upon Jacobs, his heirs, successors and assigns.
5. The effective date of this Agreement shall. be May 24, 2007, regardless of the date
when actually signed by the parties.
