MOTION FOR CONTINUANCE
AND NOW comes the Defendant/Petitioner, Larry Scott Fike, by and through his
attorney, Jane Adams, and respectfully represents the following:
I . Defendant/Petitioner is Larry Scott Fike, (hereinafter referred to as "Petitioner")
2. Respondent is the Commonwealth of Pennsylvania; the Commonwealth is represented
by Department of Transportation Attorney George Kabusk.
3. A hearing before this Honorable Court was scheduled for October 4, 2007.
4. Petitioner appealed his license suspension in Pennsylvania, which was based on
charges that were filed in Caneadea, New York.
5. Petitioner is represented by Attorney Jeffrey Lazroe, of Buffalo, New York regarding
the New York charges.
6. Counsel for Petitioner spoke with Attorney Jeffrey Lazroe regarding the final
disposition of Petitioner's charges in New York. Attorney Jeffrey Lazroe advised that he is
currently working to have Petitioner's charges reduced. He noted that the Court in Caneadea,
New York is a rural district court and does not have regular office hours, thereby causing a delay
in the disposition. He hopes to obtain a final disposition and reduction of the charges within
approximately one month's time.
7. Petitioner is requesting a continuance of the hearing scheduled in this matter until after
final disposition of the New York charges.
8. Attorney for the Commonwealth, George Kabusk, was contacted regarding this matter
and concurred with the request for a continuance. However, he requested that this matter not be
continued generally, but rather that new hearing date be set.
9. This matter was previously assigned to Judge Guido.
WHEREFORE, Petitioner respectfully requests this Honorable Court to grant his request
and continue this matter for at least one month.
