STIPULATION AGAINST LIBN$
WHEREAS, DONAI'.D A. DARROW and JOCELYN O. DARROW, husband
and wife ("Owners") the owner of the real estate described below, have or are about to
execute a contract with HAUBERT HOMES, INC., a Pennsylvania corporation
("Contractor") whose place of business is located at 15 Central Boulevard, Camp Hill,
Pennsylvania 17011 for the construction ora house on Lot No. 85, Heights of Beacon
Hill, Lower Allen Township, Cumberland County, Pennsylvania as more particularly
bounded and described on Exhibit "A" attached hereto and made a part hereof.
NOW, THEREFORE, this i~%~ day of August, 2003, before any authority had
been given by Owners to Contractor to commence work on said facilities or purchase
materials for ssme, in consideration of the making of the above-described Contract
with Owners, and in further consideration of One ($1.00) Dollar paid to Contractor by
Owners, the receipt whereof is hereby acknowledged, it is agreed that no liens or claims
sb-l! be filed or maintained against the Owners' facilities and the land above-described,
by the Contractor or any of its subcontractors, or by any of the materi-!men or

workmen, or any other person acting through or under them, for or on account of any
labor or materials purchased, or extra labor or materials purchased for, towards, in or
about the erection, construction, design and improvement of said facilities, under said
contract or otherwise, the right to have, fle and maintain such liens or claims against
the facilities and the loud above-described, being hereby expressly waived by the
Contractor for itself, its subcontractors, all materialmen, or workmen and others acting
through or under them.
IN WITNESS WHEREOF, each of the parties, by their duly authorized
representatives, have hereunto executed the Stipulation Against Liens this
of August, 2003.

.ALL THAT CERTAIN piece or parcel of land situated in Lower Allen Township,
C~mberland County, Pennsylvania, more particularly bounded and described as
follows:
BEGINNING at a point, located on the western right-of-way line of Lowell Lane at
Twenty-five Feet (25') from the centerline of the same, being the center line of a
Twenty Feet (20')'wide stormwater easement, also being the southeastern corner of
Lot No. 86.
THENCE crossing said easement and along said right-of-way of Lowell Lane, along a
curve to the right having a Radius of One Hundred Fifty-five and Zero Hundredths
Feet, an Arc length of One Hundred Eight and Forty-eight Hundredths Feet, following
a chord bearing of South Forty-two Degrees Thirteen Minutes One Second West, a
chord distance of One Hundred Six and Twenty-eight Hundredths Feet (R= 155.00',
A= 108.48', S 42°13'01" W - 106.28') to a point on the eastern corner of Lot No. 84.
THENCE leaving said right-of-way of Lowell Lane and along Lot No. 84, North
Twenty-seven Degrees Forty-four Minutes Zero Seconds West, a distance of Seventy-
five and Zero Hundredths Feet (N 27°44'00'' W - 75.00') to a point on the common
corner of Lot Nos. 83, 84 and 85.
THENCE along the property line of Lot No. 83, North Fifteen Degrees Eighteen
Minutes Forty-six Seconds East, a distance of Fifty-one and Ninety Hundredths Feet
(N 15°18'46" E - 51.90') to a point on the center line of the above referenced easement,
being the common corner of Lot Nos. 83, 85 and 86.
THE. NCE along the property line of LOt No. 66, being the center line of said
storiawater easement, South Sixty-seven Degrees Forty-nine Minutes Fifty-eight
Seconds East, a distance of One Hundred and Zero Hundredths Feet (S 67°49'58" E -
100.00') to the point and place of BEGINNING.
CONTAINING 6,990.11 Square Feet or 0.160 Acres.
BEING commonly known as 1649 Lowell Lane.
BEING Lot No. 85 on the Revised Final Subdivision Plan of the Heights of Beacon
Hill, Phase II, prepared by Melham Associates, P.C., dated June 29, 2001, last revised
September 10, 2001, and recorded in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania in Plan Book 84, Page 38; also being known as Unit
RUG-15-2003 FRI 11:42 AH FaX NO, P, 05/11
No. 85 as shown on the Declaration Plat recorded in Right-of-Way Plan Book 12,
Page 130.
ALSO BEING part of the same premises which Beacon Hill Heights Development Corporation, a
Pennsylvania corporation, by deed dated May 28, 1997 and recorded May 30, 1997 in the Office of
the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 158, Page $20,
granted and conveyed unto BHH Partners, a Pennsylvania partnership.
UNDER AND SUBJECT to a Declaration of Planned Connn,,nity dated and recorded
May 24, 2001 in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania in Miscellaneous Book 675, Page 1092.
