THIS AGREEMENT made the '~k_day of ~c43u~ 2003, by
and between JIM MILLER CUSTOM BUILDERS, INC., of 49 Tannery Road,
Dillsburg, Pennsylvania,
AND HARRY L. STEPHENSON,
wife, of 147 S. Locust Street,
hereinafter referred to as Contractor,
SR. and BETTY M. STEPHENSON, husband and
Camp Hill, Pennsylvania,
hereinafter referred to as Owner, whereby the former undertook
and agreed to erect and construct a residential dwelling on that
certain lot of ground situate in Lower Allen Township, Cumberland
County, Pennsylvania, being Lot No. 13, Phase 1 Final Subdivision
Plan For The Manor At Fair Oaks, Upper and Lower Allen Townships,
Cumberland County, Pennsylvania, dated April 22, 2002, said plan
being recorded in Plan Book 86, Page 1. Being part of the same
premises which Susan M. Ritter by her attorney-in-fact Cecelia J.
Stoner, by Deed dated September 11, 2002 and recorded in the
Cumberland County Recorder of Deeds Office in Deed Book 253, Page
2871, granted and conveyed unto R. Hart Enterprises, Inc..
NOW THEREFORE, THIS AGREEMENT WITNESSETH~ That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.

acknowledged himself to be the President of Jim Miller Custom
Builders, Inc., a corporation, and that he as such President,
being authorized to do so, executed the foregoing instrument for
the purposes therein contained.
