Hamer, his wife Michael Manning and Associates, Contractor 1N THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA STIPULATION AGAINST LIENS VOtEREAS, Daniel M. Hamer and Angela L. Hamer, his wife, of Cumberland, Pennsylvania, are about to execute contemporaneously herewith, a contract with Michael Manning and Associates, a Pennsylvania General Parmership of Cumberland County, Pennsylvania, for the erection ora dwelling upon a lot of land situate as follows: ALL THAT CERTAIN piece or parcel of land situate in the Township of East Pennsboro, Cumberland County, Commonwealth of Pennsylvania, being more fully described as follows: BEGINNING at a point on the dedicated right-of-way line of Black Pine Drive at the dividing line of Lot No. 10 and Lot No. 11, Hickory Ridge, Phase I, recorded in Plan Book 77, Page 143. Thence by said dividing line, North 14 degrees 57 minutes 41 seconds West a distance of 175.17 feet to a point at the dividing line of Lot No. 4 and lands herein described. Thence by said dividing line North 86 degrees 14 minutes 21 seconds East a distance of 177.40 feet to a point at the dividing line of lands now or formerly oflrvin E. and Thelma Stambaugh, Tract #5. Thence by the same South 24 degrees 17 minutes 11 seconds East a distance of 151.11 feet to a point at the dividing line of Lot No. 12 and Lot No. 11, herein described. Thence by said dividing line, South 50 degrees 28 minutes 32 seconds West a distance of 181.83 feet to a point on the dedicated right-of-way line of Black Pine Drive. Thence by said right-of-way line the following three courses and distances: 1. North 39 degrees 31 minutes 28 seconds West a distance of 3.89 feet to a point. 2. By a curve to the right having a radius of 5.00 feet and an arc distance of 4.97 feet to a point. 3. By a curve to the left having a radius of 50.00 feet and an arc distance of 96.37 feet to a point, the place of BEGINNING. BEING Lot No. 11, containing 36,821.23 square feet, as shown on Final Subdivision Plan of Hickory Ridge, Phase I, recorded in Plan Book 77, Page 143, and being subject to all easements of record. NOW, the \~ day of August, 2003, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Daniel M. Hamer and Angela L. Hamer, his wife, to the said Michael Manning and Associates, a Pennsylvania General Partnership to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Michael Manning and Associates, a Pennsylvania General Partnership and the further consideration of One Dollar, to Michael Manning and Associates, a Pennsylvania General Partnership paid by Daniel M. Hamer and Angela L. Hamer, his wife, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
