Plaintiff is PNC Bank, N.A., a corporation duly organized and doing business at the above captioned address. 2. The Defendant is H. Nancy Delancey, Mortgagor and also in her capacity as Co-Administratrix of the Estate of James Allen Delancey II a/k/a J. Allen Delancey II, Deceased Mortgagor and Real 'Owner of the mortgaged property hereinafter described, and her last-known address is 1350 Centerville Road, Newville, PA 17241. 3. The Defendant is Barbara R. Delancey, Co-Administratrix of the Estate of James Allen Delancey II a/k/a J. Allen Delancey II, Deceased Mortgagor and Real Owner of the mortgaged property hereinafter described, and her last-known address is 1350 Centerville Road, Newville, PA 17241. 4. The Defendant is William A. Delancey, Co-Administrator of the Estate of James Allen Delancey II a/k/a J. Allen Delancey II, Deceased Mortgagor and Real Owner and his last-known address is 1475 W. Amity, Meridian, ID 84307. 5. On January 10, 1998, James A. Delancey II and H. Nancy Delancey made, executed and delivered a mortgage upon the premises hereinafter described to Plaintiff which mortgage is recorded in the Office of the Recorder of Cumberland County in Mortgage Book 1445, Page 202. 6. James Allen Delancey II a/k/a J. Allen Delancey II is deceased, having departed this life on September 16, 1998. 7. On December 8, 1998, the Register of Wills of Cumberland County, PA granted Letters of Administration to H. Nancy Delancey, Barbara R. Delancey and William A. Delancey. A true and correct copy of The Short Certificate is attached hereto as Exhibit 8. The premises subject to said mortgage is described in the mortgage attached as Exhibit "B" and is known as 1350 Centerville Road, Newville, PA 17241. 9. The mortgage is in default because monthly payments of principal and interest upon said mortgage due July, 2000 and each month thereafter are due and unpaid, and by the terms of said 'mortgage, upon default in such payments for a period of one month, the entire principal balance and all interest due thereon are collectible forthwith. 10. The following amounts are due on the mortgage: Principal Balance Interest 7/00 through 8/6/01 (Plus $3.4583 per diem thereafter) Attorney's Fee $ 1,500.00 Late Charges $ 105.53 Cost of Suit $ 225.00 Appraisal Fee $ 125.00 Title Search $ 200.00 $12,982.22 $ 1,289.47 GR3~ND TOTAL $16,427.22 11. The attorney's fees set forth above are in conformity with the mortgage documents and Pennsylvania Law and will be collected in the event of a third party purchaser at Sheriff's Sale. If the mortgage is reinstated prior to the Sale, reasonable attorney's fees will be charged based on work actually performed. 12. Notice of Intention to Foreclose as required by Act 6 of 1974 (41 P.S. §403) and notice required by the Emergency Mortgage Assistance Act of 1983 as amended under 12 PA Code Chapter 13, et seq., commonly known as the Combined Notice of Delinquency has been sent to Defendant by regular and certified mail. 13. Plaintiff releases H. Nancy Delancey, Barbara R. Delancey and William A. Delancey in their capacity as representatives of the Estate of James Allen Delancey II only from liability for the debt secured by the mortgage. WHEREFORE, Plaintiff demands Judgment against the Defendants in the sum of $16,427.22, together with interest at the rate of $3.4583 per diem and other costs and charges collectible under the mortgage and for the foreclosure and sale of the mortgaged property.
