LONGEY, Defendant. 1N THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA CIVIL ACTION - LAW : JURY TRIAL DEMANDED COMPLAINT AND NOW, comes the Plaintiff, Richard M. Dobson, Jr., by and through his attorneys, Mancke, Wagner & Spreha, and files the following Compla'mt: 1. The Plaintiff, Richard M. Dobson, Jr., is an adult individual currently residing at 4875 Spring Road, Shermans Dale, Perry County, Pennsylvania. 2. The Defendant, Steven M. Longey, is an adult individual currently residing at 853 Silver Lake Road, Lewisberry, York County, Pennsylvania. 3. At all times relevant hereto, the Plaint'rffwas operating a 1997 Saturn, and the Defendant was operating a 1990 Buick. 4. The facts and occurrences bere'mafter occurred at the intersection of Route 114 West and I-81 North on November 14, 2002, at approximately 8:13 p.m., in Silver Spring Township, Cumberland County, Pennsylvania. 5. At the aforementioned time and place, the Defendant was operating his vehicle on Route 114 traveling in an approximate easterly direction; the Plaintiff was operating his vehicle in the opposite direction on Route 114 in a westerly direction. 6. At the aforementioned time and place, the Defendant did turn his vehicle into the path of the Defendant's vehicle violently colliding with the vehicle in which the Plaintiff was operating. 7. As a result of the aforementioned violent collision, the Plaintiff did sustain the following injuries which include but are not limited to: A. Severe trauma to the nervous system; B. Severe shock to the nervous system; C. Substantial contusions to the chest wall; D. Fractured right wrist; E. Fractured fight forearm; 8. As a result of the aforementioned injuries, the Plaintiffhas in the past and will in the future undergo severe pain and suffering. 9. As a result of the aforementioned injuries, the Plalntiffhas in the past and will in the future undergo discomfort and loss of life's pleasures. 10. The aforementioned collision and injuries sustained by the Plaintiff were a direct result of the Defendant's careless and negligent operation of a motor vehicle in that the Defendant did: A. Operate a motor vehicle under the influence of alcohol to a degree of being incapable of safe driving; B. Operate a motor vehicle at a time when his alcohol level was in excess of .10%; C. Failed to yield the right-of-way to the PlainfiWs vehicle; D. Failed to slow his vehicle so as to avoid a violent collision with the vehicle of the Plaintiff; E. Turning in front of the Plaintiff's vehicle; F. Failing to stop his vehicle so as to avoid a collision with the vehicle of the Plaintiff; G. Failing to observe the vehicle of the Plaintiff who had the fight-of-way on Route 114; H. Improperly making a left hand turn in fi'ont of the Plaintiff's vehicle so as to violently collide with it; I. Otherwise operating his motor vehicle in violation of the provisions of the Motor Vehicle Code. WHEREFORE, Plaintiff requests this Court to enter judgment against the Defendant in an amount in excess of $20,000.00.
