Ward, by and through his attorney, Lindsay D. Baird, Esquire, and avers the following in support of his petition to withdraw as co-executor of the Estate of Almeda S. Ward: Your Petitioner, Edward J. Ward, is an adult residing at 282 Green Hill Road, Newville, Cumberland County, Pennsylvania 17241. 2. Almeda S. Ward died testate on April 16, 1997, and Letters Testamentary were granted to her children, the three co-executors named in the Will, on May 6, 1997. Copies of the Short Certificate and Last Will and Testament are attached as Exhibit "A". 3. Petitioner's co-executrices are his sisters, Marilyn W. Pomroy, of 748 Sharon Drive, Mt. Joy, PA 17552, and Beverly L. Rowe, of 150 Mulberry Drive, Mechanicsburg, PA 17055. 4. Having received his future inheritance share while Almeda S. Ward was still living, Petitioner is not named as a beneficiary in Ms. Ward's Will. 5. Petitioner has chosen to waive any right to compensation for duties he may have performed as co-executor since the Estate was opened twelve years ago. 6. The issues delaying the settling of the Estate are specific to the subdivision of the real property which Ms. Pomroy and Ms. Rowe are to share in equally as beneficiaries. 7. Ms. Pomroy and Ms. Rowe are working cooperatively to accomplish the subdivision. 8. The Estate will not be compromised in any way should Petitioner be allowed to withdraw as a co-executor. In fact, his withdrawal will simplify the remaining duties associated with settling the Estate. 9. The co-executors, Ms. Pomroy and Ms. Rowe, have signed consents to Petitioner's withdrawal as co-executor. Their consents are attached as Exhibit "B". 10. Pursuant to Pa.O.C.R. 3.5, neither Citation nor Notice is required as the parties in interest have consented to the relief sought in this petition. B. To my daughter, BEVERLY L. ROWE, the balance of the real property on the south side of Mulberry Drive, which is east o` ?aae One of Five the eastern boundary of the property at 175 Mulberry Drive and consists of the remainder of the Matthews tract and the house and accompanying Got buildings known as 150 Mulberry Drive (that part of Lot No. 1 on Plan Bobk 69, page 126 which is on the south side of Mulberry Drive). C. To my daughter, BEVERLY L. ROWE, the shed on the north side of Mulberry Drive and so much of the real property surrounding the shed so that the total value of the real property given and devised to her shall be equal to the value of the real property given and devised to Marilyn W. Pommy. It is my intent that my daughters receive real property of equal value. My Executors sire directed to subdivide such of my tracts of real estate as are necessary to make the within devises of real estate to my daughters. D. If, after execution of this Will, I convey as a gift any of my real property to my daughters, any such conveyances shall be considered as partial or whale satisfaction, as the case might be, of the devises of real property set forth in this item, valued as of the date of conveyance. E. The balance of my real property on the north side of Mulberry Drive sYiall be sold or divided between my two daughters, at the discretidri of mp executors. ITEM III - All the rest, residue and remainder of my estate, xhether real, personal or mixed of whatsoever nature and kind and Page Two of Five wheresoever situated, I give, devise and bequeath to my daughters, BEVERLY L. ROWE and MARILYN W. POMROY, in equal shares. If either of my daughters should predecease me, then I give, devise and bequeath her share to her issue, per stirpes. I have not left anything in my Will to my son, EDWARD J. WARD because I have already given to him the farm in West Pennsboro Township, Cumberland County, Pennsylvania and otherwise made provision for him during his lifetime. ITEM IV - I hereby nominate, constitute and appoint EDWARD J. WARD, MARILYN W. POMROY and BEVERLY L. ROWE as Co-executors of this my Last Will and Testament. ITEM V - I direct that my Executors not be required to post bond for the faithful performance of their duties in any jurisdiction. Ward died testate on April 16, 1997, and Letters Testamentary were granted to her children, the three co-executors named in the Will, on May 6, 1997. Copies of the Short Certificate and Last Will and Testament are attached as Exhibit "A". 3. Petitioner's co-executrices are his sisters, Marilyn W. Pomroy, of 748 Sharon Drive, Mt. Joy, PA 17552, and Beverly L. Rowe, of 150 Mulberry Drive, Mechanicsburg, PA 17055. 4. Having received his future inheritance share while Almeda S. Ward was still living, Petitioner is not named as a beneficiary in Ms. Ward's Will. 5. Petitioner has chosen to waive any right to compensation for duties he may have performed as co-executor since the Estate was opened twelve years ago. 6. The issues delaying the settling of the Estate are specific to the subdivision of the real property which Ms. Pomroy and Ms. Rowe are to share in equally as beneficiaries. 7. Ms. Pomroy and Ms. Rowe are working cooperatively to accomplish the subdivision. 8. The Estate will not be compromised in any way should Petitioner be allowed to withdraw as a co-executor. In fact, his withdrawal will simplify the remaining duties associated with settling the Estate. 9. The co-executors, Ms. Pomroy and Ms. Rowe, have signed consents to Petitioner's withdrawal as co-executor. Their consents are attached as Exhibit "B". 10.
