Holly Springs, Cumberland County, Pennsylvania, deceased, died testate on May 24, 1999, having first made a Last Will and Testament, which was duly executed on August 23, 1990, and is filed in the Office of Register of Wills of Cumberland County, Pennsylvania, at File No. 21-99-0775; and WHEREAS, Gary J. Herman, by Last Will and Testament, named Lloyd E. Herman, Jr. as Executor; and WHEREAS, Letters Testamentary were issued by the Register of Wills of Cumberland County, Pennsylvania, to Lloyd E. Herman, Jr., hereinafter called "Personal Representative"; and WHEREAS, the Personal Representative has gathered the assets and income of the estate, asset forth in the estate account ledger attached as Exhibit "A"; and WHEREAS, the Executor paid debts and deductions, asset forth in the aforesaid ledger attached as Exhibit "A"; and WHEREAS, the balance for distribution will be distributed as indicated in accordance with the terms of the Last Will and Testament; and WHEREAS, Gary J. Herman owned cone-third interest in a Disney Resorts timeshare, over which the State of Florida has jurisdiction, and which timeshare interest may or may not have any financial value at this time; and WHEREAS, no disposition has been or will be made in the near future of said itimeshare interest; and WHEREAS, Lloyd E. Herman, Jr. continues to hold in his possession certain items of household goods (as indicated in the list attached hereto as Exhibit "B") for the benefit of Derek and Monica Herman, which items will be distributed to them when they establish their own homes. NOW, THEREFORE, I, being one of the heirs (or on behalf of one of the heirs) entitled to inherit under the Last Will and Testament, do hereby acknowledge that I accept the distribution as set forth in full satisfaction and payment of all sum or sums of money, legacies, bequests, and devises as are given, devised and bequeathed to me by the Last Will and Testament, which amount is set opposite my name, with the understanding that the interest in the timeshare remains outstanding and may or may not result in a future distribution to me. -1- - _. -_ ____ _ _ _ _.. __ T..
