COMPLAINT
Plaintiff, Commonwealth Financial Systems, Inc, by and through its attorneys, Edwin A.
Abrahamsen & Associates, P.C., complains of the Defendant as follows:
1. Plaintiff, Commonwealth Financial Systems, Inc, (hereinafter "Plaintiff') is a
Pennsylvania corporation with a principal place of business located at 120 N. Keyser Ave.
Scranton PA 18504.
2. The Defendant Vivian D Sampson (hereinafter "Defendant") is an adult
individual residing at 408 1St St Carlisle PA 17013.
3. At all relevant times herein, Plaintiff was engaged in the business of debt purchase
and collection.
4. Defendant applied for and received a credit card issued by Direct Merchants
Credit* with the account number 5458004043121993.
5. The within account was sold by Direct Merchants Credit* to Unifund for valuable
consideration and all rights under said accounts were assigned to Unifund.
6. On or about June 18, 2002 Plaintiff was assigned all rights to certain
credit card accounts from Unifund, including the account opened by Defendant with account
number 5458004043121993. (See, Bill of Sale, Affidavit, and Assignment attached hereto as
Exhibit "A.")
7. Use of the Direct Merchants Credit* credit card was subject to the terms of the
Cardmember Agreement, a copy of which was sent to the Defendant along with the credit card.
(See, Copy of Cazdmember Agreement, attached hereto and marked Exhibit '~.")
8. Defendant used the Direct Merchants Credit* credit cazd account number
5458004043121993, for purchases, cash advances and/or balance transfers.
9. The Defendant was mailed account statements relative to the Defendant's use of
the subject credit card.
10. The Defendant defaulted under the terms of the Agreement by failing and refusing
to make monthly payments on the account as they became due.
11. The account became delinquent on September 13, 2005.
12. The principal amount was $2,030.38 at the time it was received by Plaintiff.
13. Pursuant to the account agreement, any unpaid balance accrues interest at the rate
of 18.
14. The total amount due and owing the Plaintiff including interest, is $5,024.88.
15. Pursuant to the terms of the Agreement, Defendant is liable for Plaintiff s court
costs and reasonable attorney's fees in the amount of 25% of the balance.
WHEREFORE, Plaintiff requests judgment in its favor and against Defendant in
the amount of $5,024.88 plus costs of suit, reasonable attorneys' fees of $1,256.22 and any other
relief as the Court deems just and appropriate.

DEFENDANT'S PRELIMINARY OBJECTIONS TO PLAINTIFF'S COMPLAINT
Pursuant to Pa.R.C.P. No. 1028, Defendant Sampson, by and through her attorneys,
MidPenn Legal Services, preliminarily objects to Plaintiffls Complaint and moves for its
dismissal as follows:
I. MOTION TO STRIKE/FAILURE OF PLEADING TO CONFORM TO LAW AND
RULE OF COURT
1. Plaintiff filed a Complaint demanding damages in the amount of $5,024.88 plus,
interest, costs, and attorneys' fees.
2. Plaintiff has failed to attach to the Complaint a signed account agreement between
Plaintiff and Defendant. Although this agreement would form an essential piece of
Plaintiffls case, such a writing has not been appended,to the Complaint, nor its
absence explained, as required by Pa. R.C.P. No. 1019(1).
II. MOTION TO STRIKE//INSUFFICIENT SPECIFICITY OF PLEADING
3. Paragraph's 1-2 are incorporated herein by reference hereto
4. As a whole, the Complaint is grossly vague and lacking in factual averments such that
Defendant is without knowledge or information sufficient to form a meaningful
response and prepare a defense.
5. The Complaint fails to provide any documentation or accounting of charges allegedly
made by Defendant, which would support Plaintiff's claim of damages, such as a
breakdown of charges, payments, and interest, so that Defendant can properly
formulate a response and assert any counterclaims.
6. Given the generality of Plaintiff s allegations and failure to attach relevant
documentation to support its claim, the Complaint fails to satisfy the Pennsylvania
Rules of Civil Procedure.
WHEREFORE, Defendant Sampson, demands that Plaintiff s Complaint be
dismissed.

I. PLAINTIFF'S COMPLAINT IS SLiFFLCIENTLY SPECIFIC AND THE
CARDMEMEBER AGREEMENT UPON WHICH THE ACTION IS
BASED WAS ATTACHED TO 'THE COMPLAINT
1. Admitted.
2. Denied. The allegations of paragraph 2 of Defendant's preliminary
objections aze conclusions of law to which no response is required. To the extent a
further response is deemed necessary, Plaintiff denies that the Complaint is defective in
any manner, and particulazly as alleged by :~~efenc±ant. To the contrary, Plaintiff properly
pleaded and attached the terms of the agre~~;n~;nt upon which the cause of action is based.
It is particularly denied that Plaintiff is req~~ ir~~d to attach a signed agreement.
WHEREFORE, Plaintiff respectfu?'ly ;-egLRests this Honorable Court to deny the
Defendant's preliminary objections and av~ard co~znsel fees and such other relief as the
court deems just and appropriate.
II. PLAINTIFF'S COMPLAINT SL"FFICIENTLY SETS FORTH
A CAUSE OF ACTION
3. Plaintiff incorporates by reference the allegations of its Complaint and its
responses to paragraphs 1-2 of Defendant's Preliminary Objections, as if fully set forth
herein at length.
4. Denied. The allegations oi's aragraph 4 of Defendant's preliminary
objections are conclusions of law to which no response is required. To the extent a
further response is deemed necessary, Plaintiff denies that the Complaint is deficient in
any manner whatsoever, and particularly a alleged by Defendant. To the contrary,
Plaintiff sufficiently sets forth and attache; the Cardmember Agreement, states how much
was owed on the account when Defendant stopped paying, and alleged the date on which
the account became delinquent. Moreover, the Complaint is sufficiently specific to
allow Defendant to prepare her defense, if any.
5. Denied. The allegations of paragraph 5 of Defendant's preliminary
objections are conclusions of law to which nc response is required. To the extent a
further response is deemed necessary, Plaintiff denies that the Complaint is deficient in
any manner whatsoever, and particularly as alleged by Defendant. To the contrary, the
Complaint set forth specifically the principal balance at the time it became delinquent and
the rate at which Defendant is being charged interest pursuant to the Cardmember
Agreement. Further, it is denied that Plaintiff is required to set forth in the Complaint
every charge made on the account.
6. Denied. The allegations of paragraph 6 of Defendant's preliminary
objections are conclusions of law to which rio response is required. To the extent a
further response is deemed necessary, Plaintiff de~iits that the Complaint fails to comply
with the Pennsylvania Rules of Civil Procedure in, any manner and particularly as alleged
by Defendant. To the contrary, Plaintiff sufficiently alleged and attached the
Cardmember Agreement and set forth allel;ations to satisfy all pleading requirements.
WHEREFORE, Plaintiff respectfullyrequwts this Honorable Court to deny the
Defendant's preliminary objections and award counsel fees and such other relief as the
court deems just and appropriate.
