STIPULATION AGAINST LIENS
THIS AGREEMENT made theE day of September, 2003, by and between,
RINE & RINE BUILDERS, of Shippensburg, Pennsylvania, hereinafter referred to as Contractor,
AND
MARLIN E. GARMAN and ANN M. GARMAN, husband and wife, presently of Carlisle,
Pennsylvania, hereinafter referred to as Owner,
WHEREAS, the said Contractor undertook and agreed to make certain improvements to
Owner's property situate in Cumberland, Pennsylvania, known as Lot No. G-14, Freedom Drive, in
Plan Book 86, at Page 29, situate in Shippensburg, Southampton Township, Cumberland County,
Pennsylvania, more fully described in Exhibit 'A" attached hereto and made a part hereof.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of One Dollar ($1.00) to said Contractor in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement
aforesaid, for himself, and his subcontractors, and all parties acting through or under them, covenant
and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and improvements and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said improvements on the
lot above described, and the said Contractor, for himself, his subcontractors and others under him
hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or
claims against the said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

ALL the following described real estate, together with improvements thereon erected,
lying and being situate in Southampton Township, Cumberland County, Pennsylvania,
more particularly described as follows:
BEGINNING at an iron pin on the westerly side of Freedom Drive at comer of Lot G-15
on the hereinafter referred to plan of lots; thence by said Lot G-15, South 79 degrees 39
minutes 0 seconds West 130 feet to an iron pin on line of lands now or formerly of J.
Gary Rine, et ux; thence by said lands now or formerly of J. Gary Rine, et ux, North 10
degrees 21 minutes 0 seconds West 90 feet to an iron pin at comer of Lot G-13 on said
plan of lots; thence by said Lot G-13, North 79 degrees 39 minutes 0 seconds East 130
feet to an iron pin on the westerly side of Freedom Drive; thence with the westerly side of
Freedom Drive, South 10 degrees 21 minutes 0 seconds East 90 feet to an iron pin, the
place of BEGINNING.
BEING Lot G-14, containing 11,700 square feet, on subdivision plan prepared by Carl D.
Bert dated April 10, 2002, entitled "Land Subdivision for Rine Estates, Phase VII," and
recorded in Cumberland County Plan Book 86, Page 29.
ALSO being that same real estate that J. Gary Rine, Virginia B. Rine, husband and wife,
and Darrin G. Rine and Loretta L. Rine, husband and wife, by their deed dated August 8,
2003 and recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Deed Book ~ at Page L/~ l ~, conveyed to Marlin E. Garman
and Ann M. Garman, husband and wife, Grantors and Mortgagors herein.
