WHEREAS, Robert A. Ettlinger and Marjorie E. Ettlinger of 461 Tourist Park Road, Halifax,
PA 17032, is about to execute contemporaneously herewith, a contract, with C & C
Construction of 5745 Spring Road, ShermansDale, PA, for the erection of a building upon
premises commonly known as Lot 27 Halyard Way, Township East Pennsboro, Cumberland
County, Pennsylvania, as set forth in the deed dated 05/11/07, recorded at Deed Book 280,
Page 92, in the Recorder's Office for Cumberland County, Pennsylvania, as more
specifically described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, July 11, 2007, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor
to commence work on the said building, or purchase materials for the same in consideration
of the making of the said contract with Contractor and the further consideration of One
Dollar ($1.00), to contractor paid by Owner, it is agreed that no lien shall be filed against the
building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen
or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly
waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THAT CERTAIN piece, parcel or lot of lands situate in East Pennsboro
Township, Cumberland County, Pennsylvania; designated as Lot 27 of River Bend - A
Planned Community, as recorded at Plan Book 76, Page 83; and being further bound
and described as follows, to wit:
BEGINNING at a point on the easterly line of Halyard (a 40-foot wide public
street) at a comer of Lot 26; thence along Lot 26 S 63° 08' 41" E a distance of
318.25 feet to a point on line of lands now or forrnerty Rickey A. Shuler, thence along
said lands of Shuler S OT° 59' 39" E a distance of 44.11 feet to a rebar (found} along
the northern sine of Woodrow Avenue {unopened); thence along said line
S 64° 24' S4" W a distance of 114.58 feet to a point at a comer of Lot 28; thence along
Lot 28 the following two {2) courses and distances:
1. N 66° 58' 41" W a distance of 276.27 feet to a point;
2. N 38° 18' 30" W a distance of 30.00 feet to a point'on the southerly tine of
Halyard;
thence by said line of Halyard, along a line curving to the left and having a radius of
316.39 feet, an arc length of 137.15 feet and a chore! bearing of N 39° 16' 25" E a
distance of 136.08 feet to a point, the place of BEGINNING.
BEING known and numbered as 510 Halyard Way, Enoia, Pennsylvania 17025.
AND SUBJECT, NEVERTHELESS, to any and alt liens, mortgages, easements,
covenants, conditions, restrictions, reservations, rights-of--way, zoning ordinances,
building sines and any and all other matters that are of record or visible on the premises.
