Janice Lee Smith, being duly sworn deposes and says as follows:
Deponent is Executrix of the Estate of Nevin Leroy Smith, Deceased, who died
December 20,2006, a resident of 6 Wesley Court, Rockville, Montgomery County, Maryland
20850.
Deponent desires to exercise within the Commonwealth of Pennsylvania the authority
vested in deponent by virtue of20 Pa. Cons. Stat. 94101 and has complied with all the
provisions of same.
After diligent search and inquiry, deponent states that so far as deponent has been able
to discover, the above decedent is not indebted to any person in the Commonwealth of
Pennsylvania, and that deponent will not exercise any poser which she would not be permitted
to exercise in the jurisdiction of her appointment.

LAST WILL AND TESTAMENT
OF
NEVIN LEROY SMITH
I, NEVIN LEROY SMITH, of the County of Montgomery, State of
Maryland, being of sound and disposing mind, memory and under-
standing, do hereby make, publish and declare this instrument as
and for my Last Will and Testament, hereby revoking, annulling
and making void any and all wills and codicils heretofore made
by me.
ITEM I: I direct my Executrix, hereinafter named, to pay
out of my estate the expense of my last illness, funeral and
burial including a suitable grave site, marker and perpetual
care if deemed appropriate, in such amount as she may deem prop-
er, and without regard to any limitation imposed by law or rule
of court, as soon after my death as may be practicable, and with-
out application to or approval of any court.
ITEM II: I do hereby give, devise and bequeath all the
rest, residue and remainder of all property, real, personal or
mixed, wheresoever situate, which I may own or in which I may
have any interest at the time of my death, to my wife, JANICE
* S~iITH, absolutely and in fee simple, provided that she sur-
vives me; but if she does not survive me or if it is difficult
or impracticable to determine which one of us survives the oth-
er, then I give said property instead to GEORGE H. SMITH, as
Trustee, in trust, to hold the same with full discretionary
powers of management, of sale and resale, in fee simple or other
wise, of mortgage, of exchange, of lease, of investment and re-
investment, of convey?nce, assignment and delivery, all without
restriction as to investments which may be declared legal for
trust funds by any statutes, court decisions or rule of court
and all without application to any court; and to receive and
collect the rents, interest and dividends, and all other income

of every kind whatsoever, and after paying all such costs, charg-
es and expenses which may be considered proper by the Trustee in
connection with the exercise of any of the powers herein conferr-
ed, to use all or whatever part of the principal or income of
said trust funds as he in his absolute discretion shall deem ad-
visable for the support, welfare, education, comfort and
convenience of my children, DENNIS EDWARD SMITH and MELISSA ANN
SMITH, and any other children who may hereafter be born to or
legally adopted by me, until such time as -the youngest of such
children then surviving shall attain the age of twentyone (21)
years and then to distribute one (1) equal share of said trust
funds then remaining to each of such then surviving children,
absolutely and in fee simple; but if any of my aforesaid child-
ren shall die before the trust is distributed as aforesaid, or
shall predecease me, leaving issue surviving me, the share of
such deceased child shall go to his or her issue, per stirpes,
but if there be no issue of said deceased child surviving me,
the share of such deceased child shall go instead to the other
of the above-named children then surviving, or the then sur-
viving issue of such children who may be then deceased, per
stirpes, to be held hy the Trustee and distributed under the
same terms and conditions as hereinabove set out; but if all of
the above-named children and their issue shall die, before the
trust is dJ.stributed under the terms aforesaid, or shall pre-
decease me, then the trust corpus shall be distributed one-half
to my wife's brother, DAVID S. TRAYNOR, or his heirs, per stir-
pes, in fee simple, and one-half to the children of my previous
marriage, DE~"NIS St-HTH, KIRBY SMITH, NARILYN S~lITH, and DUANE
SMITH, or the survivors, if any be deceased.
During the existence of this trust, the Trustee shall pay
such portion of the income and principal thereof to or for the
benefit of such of the beneficiaries as the Trustee, in his dis-
cretion shall deem advisable, for their support, welfare, educa-

tion, comfort and convenience and shall accumulate and add to
principal any income not so used or paid. In ~aking distribu-
tions of income and principal, the Trustee may, in his absolute
discretion, pay more income and principal to or for the benefit
of one or more of said beneficiaries than he does for others and
may omit paying income and principal to or for the benefit of
one or more of said beneficiaries.
ITEt-1 III: If my wife, JANICE LEE SMITH, shall not survive
me, I appoint my wife's parents, ROBERT S. and MARGARET D. TRAY-
NOR, as guardians of the person and property of each of my minor
children, but if my wife's parents are or become unable or
unwilling to serve, then I appoint ROBERT and HELEN SKAPtffiA to
serve as guardians in their stead.
ITEM IV: I hereby name, constitute and appoint my wife,
JANICE LEE SMITH, to be Executrix of this my Last Will and Test-
ament, provided that she survives me; but if she predeceases
me or is or becomes unable or unwi.lling to serve then I direct
that my wife's brother, DAVID S. TRAYNOR, be appointed Executor
in her stead. I further direct that if GEORGE H. S~lITH does not
survive me, or is or becomes unable or unwilling to serve as
Trustee, then I name GARY M. NE~1AN to serve in his stead as
Trustee. I request that no bond or undertaking be required of
said Executrix or Executor or my Trustee in this or in any other
jurisdiction in which they may deem it necessary or advisable to
qualify.
I hereby authorize and empower my said Executrix or Execu-
tor or Trustee to retain any property which I may own at the
time of my death, without any liability or responsibility for
any loss or damage which may result to my estate by reason of
such retention.
ITEM V: In making this Will I have deliberately omitted
the children of my first mar~iage except as ultimate partial
