WHEREAS, Stephen P. Fanion and Linda E. Fanion of 111 North Madder Drive,
Mechanicsburg, PA 17050, is about to execute contemporaneously herewith, a contract, with
J.W. Mumper Construction, Inc. of 6 Lynchburg Ct. Mechanicsburg, PA, for the erection of a
building upon premises commonly known as 2 Petersburg Court, Township Silver Spring,
Cumberland County, Pennsylvania, as set forth in the deed dated 06/05/07, recorded at Book
280, Page 1841, in the Recorder's Office for Cumberland County, Pennsylvania, as more
specifically described in Exhibit "A" which is incorporated herein and attached hereto.

NOW,, at the time of and immediately before the execution of the principal contract, and
before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making
of the said contract with Contractor and the further consideration of One Dollar ($1.00), to
contractor paid by Owner, it is agreed that no lien shall be filed against the building by the
Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other
person for any labor, or materials purchased, or extra labor or materials purchased for the
erection of said building, the right to file such liens being expressly waived.

ALL THAT CERTAIN lot and parcel of land situated, lying and being in the Township of Silver Spring,
Cumberland County, Pennsylvania, more particularly bounded and described in acc~0anl ~ ~sed'May
Subdivision Plan for HILLSIDE FARMS, PHASES III AND IV, dated November 17, ,
24, 2002, as recorded in the Office of the Recorder of Deeds of Cumberland County in Plan Book 87,
Page 23, as follows:
BEGINNING at a point on the on the eastern line of Harpers Ferry Way at the southwestern comer of Lot
No. 60; thence along the division line between Lot Nos. 59 and 60, South 80 degrees 57 minutes 27
seconds East, a distance of 177.21 feet to a point at a common comer of Lot Nos. 59 and 58; thence
along the division line between Lot Nos. 59 and 58, South 07 degrees 34 minutes 40 seconds West, a
distance of 258.14 feet to a pant along the northern side of a cul-de-sac known as Petersburg Court;
thence along the Northern side of said cul-de-sac along a curve to the left having a radius of 95.00 feet an
arc length of 91.95 feet, a chord bearing South 67 degrees 26 minutes 09 seconds West, a distance of
88.40 feet to a pant; thence continuing along the cul-de-sac for Petersburg Court along a curve to the
right having a radius of 60.00 feet an arc length of 59.42 feet, a chord bearing South 68 degrees 04
minutes 44 seconds West, a distance of 57.02 feet to a point; thence continuing along Petersburg Court ,
North 83 degrees 32 minutes 58 seconds West, a distance of 24.47 feet to the beginning of a curve
connecting the northern line of Petersburg Court with the eastern tine of Harpers Ferry Way; thence
along said curve to the right, having a radius of 20.00 feet, an arc length of 31.42 feet, a chord bearing
North 38 degrees 32 minutes 58 seconds West, a distance of 28.28 feet to a pant on the Eastern line of
Harpers Ferry Way; thence along the eastern line of Harpers Ferry Way, North 06 degrees 27 minutes 02
seconds East, a distance of 315.98 feet to the point and place of BEGINNING.
