On 08/28/2006 SUELLA BENTZEL made, executed, and delivered a mortgage upon the premises hereinafter described to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. AS A NOMINEE WMC MORTGAGE CORP. which mortgage is recorded in the Office of the Recorder of CUMBERLAND County, in Book: 1966, Page: 1615. PLAINTIFF is now the legal owner of the mortgage and is in the process of formalizing an assignment of same. The mortgage and assignment(s), if any, are matters of public record and are incorporated herein by reference in accordance with Pa.R.C.P. 1019(g); which Rule relieves the Plaintiff from its obligations to attach documents to pleadings if those documents are of public record. 4. BENTZEL on NOVEMBER 1985, Defendant SUELLA BENTZEL became sole owner of the mortgaged premises as surviving tenent by the entireties. File #: 154849 13. Mortgagor SUELLA BENTZEL died on 12/29/2006, and MARY ANN BITTNER was appointed Administratrix of her estate. Letters of Administration were granted to her on 01/05/2007 by the Register of Wills of CUMBERLAND County, No. 21-07-18. Decedent's surviving heir(s) at law and next-of--kin are MARY ANN BITTNER, YVONNE LYNN WHITZEL. 14. By executed waiver dated 06/01/2007, YVONNE LYNN WHITZEL waived her right to be named as a defendant in the foreclosure action. Said waive is attached as Exhibit "A". 15. Plaintiff does not hold the named Defendant, MARY ANN BITTER, personally liable on this cause of action and releases them from any personal liability. This action is being brought to foreclose their interest in the aforesaid real estate only. 16. Defendant(s), MARY ANN BITTNER has been named in accordance with Pa R.C.P. 1144(a)(2), in order to divest the equitable interest(s) in the premises and has/have no personal liability for the debt secured by the mortgage. 17.
