MOTION FOR STATUS CONFERENCE
1. The Honorable J. Wesley Oler, Jr., entered an Order on March 26,2007, in response
to the Estate's Motion for a Protective Order regarding the depositions of Mrs. Barbara McK.
Mumma, Ms. Lisa M. Morgan, and George Hadley. See, Exhibit "A."
2. Based upon the March 26, 2007 Order, depositions for those three individuals were
ordered to take place in Florida and time limits were placed on the deposition lengths.
3. Mrs. Mumma and Mrs. Morgan, through their counsel, have made numerous requests
to have the depositions scheduled without response from Robert M. Mumma II and/or his counsel
of record.
4. Mrs. Mumma and Mrs. Morgan request a Status Conference before the Honorable
J. Wesley Oler, Jr., to determine the date by which depositions must be completed and/or specific
dates for the completion of the above depositions. See letters dated March 13,2007, April 2, 2007,
and April 30, 2007, attached hereto as Exhibit "B."

WHEREFORE, Mrs. Mumma and Mrs. Morgan respectfully request that the Court enter an
Order scheduling a Status Conference for the above case and granting any and all such additional
relief as the Court deems appropriate.

ORDER OF COURT
AND NOW, this 26th day of March, 2007, upon consideration of the
Estate's Motion for a Protective Order regarding the depositions of Ms. Barbara
McK. Mumma, Ms. Lisa M. Morgan, and George Hadley it is ordered and directed
as follows:
1. The deposition of Ms. Barbara McK. Mumma shall take place in
Florida, at a location mutually agreed upon by the parties. Ms.
Mumma's deposition shall be limited to between two and four
hours.
2. The deposition of Ms. Lisa M. Morgan shall take place in
Florida, at a location mutually agreed upon by the parties. Ms.
Morgan's deposition shall be limited to one day (six hours).
3. The deposition of Mr. George Hadley shall take place in Florida,

4. The Estate shall bear the reasonable cost incurred iIi,~ciati~:~

reimbursement of associated cost must be submitted to the Court
for a determination of reasonableness.

5. George Hadley is appearing in Florida for the limited purpose of
being deposed by the beneficiaries of the estate and is not making

himself available for any other legal purpose and may not be
served with subpoena or other legal process.
6. George Hadley shall be compensated at the rate of $225 per hour
for any work he does in preparation for and attendance of his
deposition.

Dear Mr. Mumma:
At the end of your sister's deposition, we had talked about everyone's desire to keep this case
moving forward. To facilitate that desire, we discussed adjourning the depositions to Florida with
the proviso that we would get the Court's approval to pay the reasonable transportation costs of the
parties. After some effort, we have been able to confirm that both executrixes, George Hadley and
Ralph Jacobs, would be available during the week of April 16, 2007, to get all ofthese depositions
concluded. From the copy of the enclosed letter, you can see that I have requested that Judge Oler
set a hearing with that date in mind. Please let us know if you would be available that week if Judge
Oler's decision is rendered in time. That way, parties can at least make some tentative arrangements
with their family and business schedules.

This will confirm our telephone conversation of April 2, 2007. At that time, you indicated
that your firm would not be available during the week of April 16, 2007 to conclude the depositions
of Mrs. Morgan and Mrs. Mumma. As you know, we had also attempted to schedule the deposition
ofthe Accountant, George Hadley, for that week. In that regard, I am enclosing a copy of the Court's
Order regarding these depositions. You indicated that you are meeting with the other members of
your firm, who are participating in representing Robert M. Mumma, II, and will get back to us with
some time where you would have four consecutive days available to conduct these depositions in
Florida. By copy of this letter, I am notifying all of the other people who had been holding those
dates, so that they can free up their calendars.

As you know, Judge Oler has now issued an Order in the Orphan's Court matter providing
time frames for the completion ofthe deposition of Lisa Morgan and Barbara McKimmie Mumma.
That Order also included a time and some restrictions for the deposition of George Hadley, the
Accountant. I had asked Mr. Mumma and Eric Weiner to provide some dates when we can get all
of these depositions accomplished. Since you have now entered your appearance, please give me
