Plaintiff, Estate of Geraldine Mae Hockley, by Sammy E. Hockley, Executor of the Estate of Geraldine Mae Hockley is an adult individual residing at 442 North West Street, Carlisle, Pennsylvania. 2. Decedent, Geraldine Mae Hockley, has been deceased since December 25, 2003. 3. Defendant, ACCO Financial Services is a Pennsylvania financial services institution with offices believed to have been located at Oliver Building, Ellen Square, Pittsburgh, Pennsylvania 15222. 4. Defendant, Beacon Consumer Discount Services is a financial services institution believed to have been located at 58 North Main Street, Pittston, Pennsylvania 18640. 5. To date, undersigned counsel and executor have been attempting unsuccessfully, to complete the administration of the estate. 6. Decedent had several outstanding mortgages, which have been paid and that need to be satisfied before administration can be completed. 7. Counsel has attempted to contact the lenders but has not been able to locate them at the addresses on record with the Department of State. 8. Plaintiff is the now and for many years past has been the lawful owner and in possession of the premises known as 123 South East Street, Carlisle, Pennsylvania. 9. Plaintiff purchased the property on December 31, 1949, subject to a mortgage given to AVCO Financial Services by Albert S. and Caroline M. Hockley dated December 7, 1979, and recorded on December 12, 1979, in the office of the recorder of deeds, Cumberland County, Pennsylvania in Mortgage Book 673, page 943. The amount of the mortgage was $1,728.00, subject to a mortgage given to Beacon Consumer Discount Services, by Albert S. and Caroline M. Hockley dated February 12, 1974, and recorded on March 27, 1974, in the office of the recorder of deeds, Cumberland County, Pennsylvania in Mortgage Book 575, page 1047, the amount of the mortgage was $2,554.00 and subject to a mortgage given to Beacon Consumer Discount Services by Albert S. and Caroline M. Hockley dated August 4, 1977, and recorded on August 10, 1977, in the office of the recorder of deeds of Cumberland County, Pennsylvania, in Mortgage Book 627, page 364 in the amount of $2,628.00. 10. Plaintiff previously paid the amount secured by the mortgages to the Financial Institutions. 11. The Financial Institutions promised to satisfy the mortgages of record at the time of payment. 12. Notice to Record Mortgage Satisfaction Piece was mailed to AVCO Financial Services on March 11, 2005, and the return envelope is attached as (Exhibit "A"). 13. Notice of Record Mortgage Satisfaction Piece was mailed to Beacon Consumer Discount Company on March 11, 2005, and the return envelope is attached as Exhibit "B"). 14. Notice of Record Mortgage Satisfaction Piece was mailed to Beacon Consumer Discount Company on March 11, 2005, and the return envelope is attached as Exhibit "C"). 15. The title agent, who oversaw the sale of Decedent's real estate, James Hughes, has also refused to satisfy the mortgages to date, or release the funds from the sale of Decedent's residence, attached please find a letter from Attorney Hughes. (Exhibit "D") 16. The Financial Institution's failure to satisfy the mortgage obscures plaintiffs title in the property. 17. Undersigned counsel published notice of decedents' death in the Cumberland County Law Journal on March 5~', 12`t', and 19`~ of 2004 and the Sentinel on February 27, 2004, March 5~' and 19`~ of 2004. 18. No creditors, including the foregoing mortgage holders have made a claim. WHEREFORE, plaintiff requests judgment in his favor and that the Court order the mortgage be marked satisfied of record, by Judicial Decree.
