HERTZLER, in her lifetime, made an original pledge of One Hundred Thousand ($100,000.00) Dollars to DREXEL UNIVERSITY and paid approximately Eight Thousand ($8,000.00) Dollars of that pledge with securities; and WHEREAS, MARY S. HERTZLER subsequently elected not to complete the pledge, it being beyond the means at that time; and WHEREAS, at the death of MARY S. The heirs believe that this pledge was extracted by representatives of Drexel University at a time in Decedent's life when she was having trouble meeting her expenses. The heirs take the position that it was improper to seek such a pledge at this stage of Decedent's life, and that in any event, as a result of her financial condition, Decedent defaulted on said alleged pledge, and recovery of said pledge against Decedent's estate is barred by the statute of limitations.
