this Agreement is entered into between the ESTATE OF MARY S. HERTZLER and
DREXEL UNIVERSITY.
WHEREAS, MARY S. HERTZLER, in her lifetime, made an original
pledge of One Hundred Thousand ($100,000.00) Dollars to DREXEL UNIVERSITY
and paid approximately Eight Thousand ($8,000.00) Dollars of that pledge with
securities; and
WHEREAS, MARY S. HERTZLER subsequently elected not to complete
the pledge, it being beyond the means at that time; and
WHEREAS, at the death of MARY S. HERTZLER, DREXEL
UNIVERSITY asserted a claim against her Estate for the remainder of that pledge in
the approximate amount of $92,000.00; and
WHEREAS, after extended negotiations, DREXEL UNIVERSITY and the
Executor and heirs of MARY S. HERTZLER have agreed that this claim will be settled
in full by the payment by the heirs of a total ofcjln additional s'-;lm of Eighteen Thousand

NOW, THEREFORE, it is agreed by and between the parties that an

in settlement of pledge claim

CLAIM OF DREXEL UNIVERSITY
Drexel University has asserted a claim against this estate for $92,000, the alleged
balance of a pledge it asserts was made by Decedent during her lifetime. The heirs
believe that this pledge was extracted by representatives of Drexel University at a time
in Decedent's life when she was having trouble meeting her expenses. The heirs take
the position that it was improper to seek such a pledge at this stage of Decedent's life,
and that in any event, as a result of her financial condition, Decedent defaulted on said
alleged pledge, and recovery of said pledge against Decedent's estate is barred by the
statute of limitations. This claim has been settled. The University has agreed to accept
$18,000 from the individual heirs as settlement of this claim.
