COMPLAINT
AND NOW, comes the Plaintiff, by and through its attorneys and the law firm of Wolpoff &
Abramson, LLP, and files this Complaint and in support avers as follows:
1. Plaintiff is GE MONEY BANK , Po Box 29112 Shawnee Mission, KS 66201.
2. Defendant, TRACEY BOWERMASTER, is an adult individual with a last known
address of 207 Southside Dr Newville, Cumberland County, PA 17241.
3. An installment loan was issued to the Defendant(s).
4. The Defendant(s) agreed to be responsible for payment of interest and all court and
collection costs incurred by Plaintiff in the event of default.
5. That the Defendant(s) defaulted under the terms of the loan.

6. As of the date of this Complaint, the remaining balance due, owing, and unpaid on
Defendant's loan balance with Plaintiff is the sum of $19,507.16. A true and correct copy of a
Statement of Account identifying the balance due and owing to Plaintiff is attached hereto, incorporated
herein, and marked as Exhibit "A".
7. Pursuant to the applicable Pennsylvania law, any unpaid or delinquent balance on said
account shall continue to bear interest at the rate of 6 %. See Exhibit "A" as previously identified and
incorporated herein.
As of the date of the filing of this Complaint, the amount of interest which has accrued is
the sum of $224.46.
9. Despite reasonable and repeated demands for payment, Defendant(s) has/have refused
and continue to refuse to pay all sums due and owing on the aforementioned account balance, all to the
damage and detriment of the Plaintiff.
10. The amount in controversy is within the jurisdictional amount requiring compulsory
arbitration.

WHEREFORE, Plaintiff respectfully requests this Honorable Court enter Judgment in favor of
the Plaintiff and against Defendant(s) in the amount of $19,507.16, interest in the amount of $224.46,
plus costs of this action and any other relief as this Court deems just and reasonable.

DEFENDANT'S PRELIMINARY OBJECTIONS TO PLAINTIFF'S COMPLAINT
AND NOW, comes Defendant, Tracey Bowermaster, by and through her attorneys,
O'BRIEN, BARIC & SCHERER, and files the within Preliminary Objections and, in support
thereof, sets forth the following:
I. FAILURE OF PLEADING TO CONFORM TO LAW OR RULE OF COURT
1. A claim based upon an agreement must state specifically whether the agreement is
oral or written. Pa.R.C.P. § 1019(h).
2. If the alleged agreement is based upon a writing, the writing must be attached to
the pleading. Pa.R.C.P. § 1019(1).
3. Plaintiff has failed to plead whether the alleged agreement is oral or written and if
written, Plaintiff has failed to attach a copy of the agreement to the complaint.
II. INSUFFICIENT SPECIFICITY OF PLEADING
4. Defendant incorporates by reference Paragraphs one (1}through three (3) as
though set forth herein.
5. A pleading must include material facts upon which the pleading is based and must
state those facts in a concise and summary form. Pa.R.C.P. § 1019(a).
6. Plaintiff has failed to plead who issued the alleged loan to Defendant.
7. Plaintiff has failed to state the interest rate of the alleged loan.
8. Plaintiff has failed to state how Defendant defaulted under the alleged loan and
which terms thereof Defendant allegedly breached.
9. Plaintiff has failed to state the alleged amount owed in a concise and summary
form and instead, has attached an indecipherable Account Statement.
WHEREFORE, Defendant requests that her Preliminary Objections be sustained and
Plaintiff's complaint be dismissed with prejudice.

FIRST AMENDED COMPLAINT
AND NOW, comes Plaintiff, by and through its attorneys, Wolpoff & Abramson, LLP, and files
this Complaint and in support thereof avers as follows:
1. Plaintiff GE MONEY BANK has a principal mailing address of 4125 Windward Plaza
Drive, Alpharetta, GA 30005.
2. Defendant TRACEY BOWERMASTER is an adult individual with a last known address
of 207 Southside Dr., Newville, Cumberland County, Pennsylvania.
3. On or about June 4, 2004, Plaintiff issued anopen-end credit account bearing account
number x:XXX XXXX XXXX 5976 (hereinafter "Account") to Defendant. The Account was created
through a written contract between Plaintiff and Defendant, accepted by Defendant when she signed and
utilized the Account. A true and correct copy of the Credit Card Agreement governing the Account
(hereinafter "Agreement") is attached hereto as Exhibit "A."
4. At all relevant times material hereto, Defendant was a regular user of the Account for the
purchase of products, goods and/or for obtaining services and/or funds.
5. By virtue of Defendant's use and maintenance of the Account, she became bound to all of
its contractual terms.
6. Defendant received monthly statements which accurately stated all purchases and
payments made during the month, interest charges imposed on the unpaid balance, and the amount due.
Copies of monthly statements from May, 2003, through April, 2007, are attached hereto as Exhibit "B."
7. Defendant did not object to the accuracy of these monthly statements.

8. Defendant made sporadic and irregular payments, if any, which have been applied to the
outstanding balance of the Account; Defendant's last payment was posted on October 7, 2006.
9. As of the date of the within Complaint, the remaining balance due, owing and unpaid on
the Account, as a result of charges made by said Defendant and/or any authorized users is the sum of
$19,507.16.
10. Pursuant to the Agreement and/or applicable Pennsylvania law, any unpaid and/or
delinquent balances on said Account shall continue to bear interest at the rate of 6 %.
11. The amount of interest which has accrued on the Account is the sum of $618.88.
12. Despite reasonable and repeated demands for payment, Defendant has failed, refused and
continues to refuse to pay all sums due and owing on the Account to the damage and detriment of
Plaintiff.
13. Any and all conditions precedent to the bringing of this action have been performed by
Plaintiff.
14. The amount in controversy is within the jurisdictional amount requiring compulsory
arbitration.
WHEREFORE Plaintiff respectfully requests this Honorable Court enter judgment in favor of
Plaintiff and against Defendant, in the amount of $20,126.04, plus costs of this action and any other
relief as this Court deems proper and just.
