Petitioner COMMONWEALTH OF PENNSYLVANIA, DEPARTMENT OF TRANSPORTATION, BUREAU OF DRIVER LICENSING, Respondent IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA NO. 2003 CIVIL DIVISION (DRIVER LICENSE SUSPENSION) APPEAL FROM IMPOSITION OF IGNITION INTERLOCK SYSTEM REQUIREMENT AND NOW, comes the Petitioner, Ronald R. Sw~ger, Jr., an individual, and pursuant to 75 Pa.C.S. §1550, files this appeal from the Order of Suspension of his ddving privilege, specifically the requirement to install the Ignition Interlock System, and avers the following in support thereof: 1. Petitioner is Ronald R. Sweger, Jr. ("Sweger"), an individual, with a residence address of 604 Wertzville Road, Enola, PA 17025. 2. Respondent is the Commonwealth of Pennsylvania, Department of Transportation, Bureau of Driver Licensing ("PennDOT"), with offices at Riverfront Office Center, 1101 S. Front Street, Harrisburg, Pennsylvania 17104-2516. 3. By notice dated August 14, 2003, Sweger was notified that his Pennsylvania driving privilege was being suspended. A true and correct copy of the notice is attached hereto as Exhibit "A". 4. The Order stated that Sweger's Pennsylvania ddving privilege was being suspended for one (1) year as a result of a conviction for 75 Pa. C.S. § 3731 (relating to driving under the influence of alcohol), and that to restore his license after serving the suspension, he would be required to have an Ignition Interlock System installed in all vehicles owned by him. 5. The suspension was effective July 22, 2003. 6. Sweger is not challenging the validity of the suspension imposed. Rather, Sweger is challenging the requirement that he install the Ignition Interlock System in all vehicles owned by him in order to restore his operating privilege after serving the one year suspension. WHEREFORE, Petitioner, Ronald R. Sweger, Jr., requests that this matterbe scheduled for hearing pursuant to 75 Pa.C.S. §1550.
