Civil Term COMPLAINT AND NOW, comes the Plaintiff, Saidis, Flower and Lindsay, P.C., and respectively represents as follows: 1. Plaintiff, Saidis, Flower & Lindsay, is a Pennsylvania professional corporation with a principal place of business at 26 West High Street, Carlisle, Pennsylvania, 17013. 2. Defendant, Elizabeth J. Pecora n/k/a Elizabeth Beam, is an adult individual last known to be residing at 540 Garner Drive, Ozark, MO 65721. 3. On or about June 24, 2002, in Cumberland County, Pennsylvania, the Plaintiff and the Defendant entered into a written Fee Agreement concerning Plaintiff s professional services, a copy of which is attached hereto and incorporated herein as Exhibit "A". 4. The Plaintiff provided professional services pursuant to the terms of the agreement to the Defendant between the dates of June 26, 2002, and July 9, 2007, although active representation ceased in or about the Fall of 2006. 5. The Defendant acknowledged the terms of the Fee Agreement by making regular payments in small amounts for the professional services rendered by the Plaintiff. 6. Despite repeated demands, the Defendant has failed or refused to pay the amounts outstanding. 7. As of June 4, 2007, there was a principal balance due in the amount of 1 $22,862.57. See June 4, 2007 Invoice attached hereto as Exhibit "B". 8. The Fee Agreement provides that interest will accrue at the rate of 1'/~% per month after the first thirty (30) days. 9. For most of the time relevant to this action, Plaintiff did not assess interest; however, interest began being assessed as of June 4, 2007. 10. Interest continues to accrue on the outstanding principal balance. 11. The amount in controversy is within the Cumberland County Arbitration limits. WHEREFORE, Plaintiff demands judgment against the Defendant in the amount of $22,862.57 plus interest and costs. Street Carlisle, PA 17013 Dear Ms. Pecora: You have asked our law firm to act as your attorneys. This letter sets forth the agreement ~ncerning our representation of you. This agreement shall become effective upon our receipt of a ~untersigned copy of this letter and the retainer fee, at which time, work on your case will begin. 1. You hereby agree to pay our firm a retainer fee of X2,500.00 which is paid to us for the purpose of assuring our availability in your matter. Your retainer fee will include the initial consultation and the balance will be credited to your account for services to be performed in the future. The retainer is non- refundable. We will apply your retainer against time expended on your behalf, and at such time as that amount is exhausted, von! will be pilled regularly ~r additiur~ai time expended. 2. The basis for our fee is the amount of time spent on your matter. It is impossible to determine in advance the amount of time that will be needed to complete your case. Our billing is based on an hourly rate of $175.00 per hour. This hourly rate will prevail until December 31, 2002, after which, due to rising costs and overhead expenses, the hourly rate will be subject to increase in accordance with the then existing hourly. rate schedule. We will bill you monthly on atime-expended basis. Although we do send itemized bills as a matter of course, we do maintain in our office records of time used for conferences, telephone calls, correspondence, electronic communications, drafting documents, research, court time, and if necessary, travel time. These records will be available to you upon request. Fractions of hours are computed in periods of not less than two tenths (.2) of an hour and the interruption of other work is taken into consideration. If some of the work on your case can be done by a alegal or by a law clerk whose hourly time rates are substantially lower than mine, to the extent that it time is utilized, the overall fee will be lower. You will not be billed for clerical or secretarial time. For the preparation of certain documents you will be billed on a flat rate basis rather than a time expended basis. 3. We expect you to keep current with our billings. However, as our client, you are primarily responsible for the payment of our total fee. Of course, amounts received pursuant to court order will be credited to your account. 6. Active representation ceased on or about August 2006 when defendant relocated to Missouri. 5. Agree in Part. Defendant has made regular payments in the .amount of approximately $24,000.00 of Defendant's own monies (Exhibit A). Defendant had an IRA valued at $7,143.22 which was subject to eariy w~hdrawl in March 2003 in the amount of $6,438.22 so as to pay Plaintiff $5,000.00 on April 04, 2003, Member's First Account #200722 check #1280 (Exhibit B). Pursuant to a court order dated October 28, 2003 (Exhibit C}, Defendant was ordered guardian over marital asset know as Lot #4, Tristan Drive, Dillsburg, PA. Defendant was ordered to refinance and sell asset in order to avoid co~lmpletion of foreclosure proceeding's due to Defendant's former spouse failing to keep mortgage current with the intent to destroy the marital estate. Addition~~l payment was made in the amount of $23,488.19 to Plaintiff for judgement filed~,placing an encumbrance on the asset (Exhibit D). Plaintiff was well aware of the fact that Defendant's former spouse retalined and had control of all marital assets including a professional engineering firtm owned by Defendant and Defendant's former spouse. Defendant has paid regular payments and intermittent large sum payments when able. Defendant repeatedly expressed to Plaintiff concern regarding the' Defendant's financial position as to the Defendant's former spouse having controlling possession of all marital assets. Defendant expressed further concerns when Defendant's former spouse continued to take each asset and methodically, willfully and intentionally destroy them. Defendant believes Plaintiff should have been more aggressive due to these circumstances. Since December 2006 through may 2007, Defendant has forwarded subpoenas which have allowed for the production of necessary documents relative to the settlement of the marital estate. All of which were repeatedly asked for by Plaintiff through counsel for Defendant's former spouse. Defendant believes these actions should have been acquired by Plaintiff during representation of Defendant. Defendant has requested payment of attorney fees in Pre-Hearing Memorandum filed with the Cumberland County Divorce Master. In addition, Defendant has requested release of the Plaintiffs escrow monies on behalf of Defendant to be paid to Plaintiff in the amount of $4,466.90. Defendant also believes that these monies were paid by Defendant's former spouse as reimbursement of attorney fees resulting of the necessity of Plaintiff to file Petitions on behalf of Defendant. 6. Disagree. Defendant and Plaintiff have corresponded several times, in order to come to an agreement of a final amount (Exhibit E). 7. No Answer Required. 8. No Answer Required. 9. Disagree. Plaintiff set precedent by forgiving interest charges through June 4, 2007 and then commencing charges with a charge on the past due balance as well as current balance. 10. Object. Pecora, Plaintiff above it is hereby ordered and directed as follows: 1. Christopher S. Pecora shall immediately transfer to Elizabeth Pecora, now Elizabeth Beam, all of his right, title and interest in Saramama, LLC by Special Warranty Deed. In the event it is necessary to avoid transfer tax for Saramama LLC to transfer to Christopher S. Pecora his 90% (percent) share of Saramama before transferring his interest to Elizabeth Beam, Mr. Pecora shat! immediately do so before transferring his remaining interest as set out above. 2. Plaintiff shall refinance the property immediately, paying off the obligation of the parties to Fulton Bank, and the obligation of Saramama LLC to Biller's Masonry in the amount $2,123.25 as well as the real estate taxes due on the properly for 2003 in the amount of $2,542.05. 3. Plaintiff will make the mortgage payments on the Saramama property each and every month as they come due. Plaintiff shall continue to list the properly with CIR or such other agent as she shaft determine and at a price she determines in her sole discretion. 4. Upon sale of the property, proceeds shall be reduced by the usual costs of sale (realtors' commission and transfer tax) and by reimbursement to Plaintiff for monthly mortgage payments incurred pending the sale, the cost of refinancing as well as any additional payments made to Biller's Masonry and for 2003 real estate taxes, and insurance costs which Plaintiff will have incurred. In addition, Plaintiff shall be reimbursed for any capita! gain taxes incurred as a result of the sale of the property. The balance of proceeds shall be held in escrow pending equitable distribution. 5. Within 10 (ten) days of this date, Defendant shall provide to Plaintiff documentation of a!I the improvements done to the Saramama property since it's purchase and the cost or value of such improvements as well as a copy of the 2002 federal income tax return for Saramama LLC. Plaintiff may use the value of such improvements to offset any capital gains which she may incur as a result of the sale of the property. 6. Mr. Pecora shall not record any instrument which shall encumber or transfer any interest in the property owned by Saramama, LLC. 7. The interest is authorized by your engagement letter with the firm and we have not charged it to date in hopes that you would find a way to refire the balance. PECORA n/k/a ELIZABETH BEAM, Defendant IN RE: NONJURY TRIAL FINDINGS AND VERDICT This is a lawsuit brought by a law firm against its client for fees. We heard the matter without a jury. Having reflected on the matter at great length, we now conclude that it is judicious to make only general findings in this case. General findings are permitted by Pa.R.C.P. 1038. The defendant retained the services of the plaintiff for her family law matters. The support, custody and divorce aspects of the litigation were contentious. From the beginning of the litigation, the plaintiff was of limited means. Notwithstanding, by liquidating assets and making cash payments, the defendant has managed to pay in excess of $52,500 in legal fees to the plaintiff, a sum slightly in excess of the median income for one year for an entire household according to the U.S. Census Bureau. Counsel now seeks another $24,000. Had the plaintiff remained in the case, the intent was to pursue counsel fees before the Divorce Master. Instead, counsel withdrew from the case, effectively abandoning the claim along with the client. The defendant went away from her marriage with nothing, having given what she had to her lawyer.
