STIPULATION AGAINST LIENS
THIS AGREEMENT made this 1~day of ~u''~cL 2007, by
and between Fred A. Tiday Builders, Inc, a Pennsylvania
Corporation, hereinafter referred to as Contractor,
AND
Manish Agarwal and Neena Agarwal, husband and wife, hereinafter
referred to as Owners, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot of ground
situate in Hampden Township, Cumberland County, Commonwealth of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof and known as Lot #4
Pinehurst Hills, Mechanicsburg, Hampden Township, Cumberland
County, Pennsylvania.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

Corporation by himself as such President.

Exhibit A
ALL that certain parcel of land located in the Township of Hampden, County of
Cumberland, State of Pennsylvania in accordance with a plan entitled "Final
Subdivision Plan for Watts Tract", dated August 19, 1999 and last revised July 25,
2000.
SAID Parcel being more fully described as follows: BEGINNING at an iron pin to
be set along the eastern right of way line of Chloe Lane at the dividing line between
Unit 4 and Unit 5 as shown on the above said plan; thence along Unit 5 of said plan,
South 78 degrees 51 minutes 20 seconds East, a distance of 255.44 feet to an iron pin
to be set along the lands now or formerly of Daniel & Lonetta Wentz; thence along
said lands, South 08 degrees 18 minutes O1 seconds East, a distance of 69.85 feet to
an iron pin to be set at the corner of lands now or formerly of George Krnjac;
thence along said land, South 08 degrees 16 minutes 07 seconds East, a distance of
112.77 feet to an iron pin to be set at the dividing line of Unit 3 and Unit 4; thence
along Unit 3, North 73 degrees 35 minutes 09 seconds West, a distance of 377.38 feet
to an iron pin to be set along the eastern right of way line of Chloe as shown on said
plan; thence along Chloe Lane the following (4) four courses and distances: 1)
Along a curve to the left having a radius of 175.00 feet, a delta angle of 14 degrees 27
minutes 47 seconds, an arc length of 44.17 feet, and a chord bearing and distance of
North 08 degrees 57 minutes 19 seconds East, 44.06 feet, to an iron pin to be set; 2)
North 02 degrees 16 minutes 35 seconds East, a distance of 30.57 feet to an iron pin
to be set; 3) along,a curve to the right having a radius of 25.00 feet, a delta angle of
86 degrees 57 minutes 31 seconds, an arc length of 37.94 feet, and a chord bearing
and distance of North 45 degrees 25 minutes 50 seconds East, 34.40 feet, to an iron
pin to be set; 4) along a curve to the left having a radius of 70.00 feet, a delta angle
of 49 degrees l0 minutes OS seconds, an arc length of 60.07 feet, and a chord bearing
and distance of North 64 degrees 19 minutes 33 seconds East, 58.24 feet, to an iron
pin set at the dividing line between Unit 4 and Unit 5, the place of BEGINNING.
