HomeMy WebLinkAbout07-480907- X809 M~.,p STIPULATION AGAINST LIENS ~~ THIS AGREEMENT made this between Neidlinger Construction, referred to as Contractor, J day of August, 2007, by and a sole proprietor, hereinafter AND Larry V. Neidlinger and Mary Jo Neidlinger, husband and wife, hereinafter referred to as Owners, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in West Pennsboro Township, Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as Lot #1, Clay Road, Carlisle, PA 17013. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. McKeehan, prepared by Eric L. Diffenbaugh, Professional Land Surveyor dated May 19, 2005, and revised September 6, 2005, and February 13, 2007, and recorded in the hereinafter mentioned Recorder's Office in Plan Book 93, Page 125, as follows: BEGINNING at an existing iron pin in line of lands now or formerly of William J. Blankmeyer, Jr. and Barbara J. Blankmeyer, and in the dividing line between Lots Nos. 1 and 3; thence along the dividing line between Lots Nos. 1 and 3, South 03 degrees 51 minutes 44 seconds East a distance of 289.60 feet to a concrete monument set; thence by same, South 86 degrees 09 minutes 07 seconds West a distance of 394.35 feet to an iron pin set in the dividing line between Lot No. 1 and other lands now or formerly of the Grantors herein; thence along said other lands now or formerly of the Grantors herein, North 13 degrees 16 minutes OS seconds East a distance of 303.00 feet to an existing iron pin in line of lands of William J. Blankmeyer, Jr. and Barbara J. Blankmeyer; thence along said lands now or formerly of William J. Blankmeyer, Jr., and Barbara J. Blankmeyer, North 86 degrees 08 minutes 54 seconds East a distance of 305.10 feet to an existing iron pin in the dividing line between Lots Nos. 1 and 3, the Place of BEGINNING. CONTAINING 2.3250 Acres, and being all of Lot No. 1 as shown on the Final Subdivision Plan for William S. McKeehan, recorded in Plan Book 93, Page 125.
