BRYAN FISHBURN, : Defendant IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA CIVIL ACTION -LAW COMPLAINT 1. The Plaintiff is an adult individual residing at 536 Hummel Avenue, Lemoyne, Pennsylvania 17043. 2. The Defendant is an adult individual residing at 828 Landau Court, Camp Hill, Pennsylvania 17011. 3. The facts and occurrences hereinafter related took place on or about September 27, 2006, on Hummel Avenue in the Borough of Lemoyne. 4. At the time and place aforesaid, Plaintiff was the owner of a 1994 Toyota, which was then and there lawfully parked. 5. At the time and place aforesaid, Defendant was the operator of a motor vehicle traveling` eastbound when he lost control of his vehicle and sideswiped the Plaintiff's vehicle causing the damages hereinafter set forth. 6. The aforesaid accident and damages resulting therefrom were due to the negligence of the Defendant in that he: a) failed to keep a proper lookout for other vehicles; r b) failed to keep his vehicle under control so as to avoid striking a parked vehicle; and c) was otherwise careless and negligent. 7. Solely as a result of Defendant's negligence, Plaintiff sustained damages in the amount of FOUR THOUSAND SEVENTY-TWO and 79/100 ($4,072.79) DOLLARS.
