Knupp, Esquire, and files this Complaint a statement of which follows: 1. The Plaintiff is RestoreCore, Inc., a Pennsylvania Business Corporation, having its offices at 2322 North Seventh Street, F+arrisburg, PA 17110. 2. The Defendant is Geir Magnusson, an individual having an address of 4052 Lisburn Road, Mechanicsburg, PA 17055. 3. This Complaint is being filed in response to a Notice of Appeal from a District Justice judgment filed by the Plaintiff. A copy of the Notice or Appeal is attached hereto as Exhibit "1.° 3 4. Counsel for RestoreCore entered his appearance in this matter on September 5, 2007 and at the same time filed a letter from the Defendant granfing an extension of time to file a Complaint to September 17, 2007. 5. This Complaint is being filed within the extended period granted by the Defendant. 6. The Defendant Magnusson signed an Authorization on March 13, 2005 to allow the Plaintiff RestoreCore to pertorm work that RestoreCore deemed necessary "to complete restoration" which was occasioned by damage done to the Plaintiff's residence by a fire. A copy of the Authorization is attached as Exhibit "3." 7. At the same time, the Plaintiff signed an Emergency Authorization to allow RestoreCore to perform work deemed necessary to complete restoration and agn~eing to payment of RestoreCore's invoices for the same including "any fees for attorneys or any collection process required for non-payment of the balance of the invoice." A copy of the Emergency Authorization is attached as Exhibit "4." 8. The Plaintiff performed certain work for the Defendant which is evidenced by a Statement of Account attached hereto and made a part hereof as Exhibit "5"showing a balance due of $3,639.99. 4 9. The Statement of Account shows a credit in the sum of $1,462.15 which resulted from a payment by the Defendant. 10. A detailed break-out of the services performed constituting the sum showed. on the Statement of Account as attached hereto as Exhibit "6." 11. A further Statement showing the balance, credit for payment, and late charges is attached hereto as Exhibit "7." Exhibit "7" shows the sum due of $2,093.72. 12. In addition to the services performed, supplerental services were performed. The cost of supplemental services is the sum of $1,265.42. A detailed break-out of the supplemental services is attached hereto as Exhibit "8 " 13. Pursuant to the provisions of Exhibit "2,"the Plaintiff is entitled to recover a reasonable attorney's fee. Plaintiff believes and avers that a reasonable attorney's fee in this matter, considering the time, effort and expense involved, is the sum of $1,000.00. 5 WHEREFORE, Plaintiff seeks the recovery of $4,359.14 together with interest and costs.
