For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is 0% [72 P.S. S9116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and filing a tax return are still applicable even if the surviving spouse is the only beneficiary. ITEM I: I direct that all my just debts and funeral expenses, including my grave marker and all expenses of my last illness, shall be paid from my residuary estate as soon as practicable after my decease, as a part of the expense of the administration of my estate. Approximately two months prior to his July 23, 2006 death, the Decedent had left his home located at 720 Mountain Street, Enola, Pennsylvania 17025 to move in with his daughter, Donna Keammerer and her family at their address of 307 Autumn Chase Drive, Harrisburg, Pennsylvania 17110. The Decedent's declining health meant he was unable to live alone in his house. The Decedent's mailing address was changed to his daughter's address and his clothes and other necessary personal property were moved to his daughter's home.
