Kerr, Esquire, and files the within Mechanic's Lien Claim, the nature of which is as follows: 1. Claimant, Mechanical Electrical Services L.L. C., is a limited liability company organized and registered pursuant to the laws of the Commonwealth of Pennsylvania with an address at 602 Monroe Street, Steelton, Pennsylvania .17113. 2. The owners in fee of the property subject to the lien are William R. and Robin Balaban, husband and wife, who reside at 312 North 26th Street, Camp Hill, Pennsylvania 17011. The property subject to the lien is this same real property located at 312 North 26th Street. Camp Hill, Pennsylvania 17011. 3. The date on which the work was completed for which this claim is being made was June 17, 2007. 4. Claimant is filing this claim as a contractor under the Mechanic's Lien Law of 1963, 49 P.S. § 1101, et. seq. 5. The amount claimed to be due is 2 712.32 and is for the materials and services performed on the property in connection with the installation of the underground rough-in plumbing for a planned addition to the real estate.. A copy of the Job Invoice is appended to this claim. 6. The improvement and property claimed to be subject to the lien is the real property and improvements located at 312 North 26th Street, Camp Hill, Pennsylvania 17011. WHEREFORE, Claimant, Mechanical Electrical Services L.L.C., claims to have a lien upon the premises herein described in the amount of $2,712.32, plus interest, costs of suit and such other relief as the Court may deem appropriate. S. & 1505 AND NOW, this 20th day of December, 2007, pursuant to 40 P. S. § 1505 come William R. Balaban and Robin Balaban, Owners, by and through their attorneys, Elliott Greenleaf Siedzikowski & Balaban, and file Preliminary Objections to strike Claimant's Mechanic's Lien based upon Claimant's failure to comply with the Mechanics' Lien Law of 1963, as amended, and in support thereof aver the following: 1. Claimant, Mechanical Electrical Services, LLC, filed its Mechanic's Lien in the captioned matter on August 17, 2007 (See Exhibit "A", attached hereto and made a part hereof). 2. Paragraph 3 of Claimant's Mechanic's Lien states that the work was completed on June 17, 2007. 3. 49 P. S. § 1502(a)(2) requires that written notice of the filing of a Mechanic's Lien must be served on the Owner(s) within one (1) month after filing and an Affidavit of Service be filed with the Prothonotary of the Cumberland County Court of Common Pleas within twenty (20) days after service. 4. Claimant's Mechanic's Lien (Exhibit "A") has not been served on Owners, William R. Balaban and Robin Balaban. .. 5. Claimant, Mechanic Electrical Services, LLC, has not filed an Affidavit of Service with the Prothonotary of the Cumberland County Court of Common Pleas. 6. Compliance with 49 P. S. § 1502 is apre-requisite to the validity of Claimant's Mechanic's Lien and the failure to observe it invalidates Claimant's Mechanic's Lien. (see: Re eg_ncy Investments, Inc. T/D/A/ Regency Commercial Maintenance Appellant v. Inlander Limited, A Nevada Corporation, Appellee, 2004 Pa. Super. 274, 855 A.2d 75 (2004)) 7. The service requirements under 49 P. S. § 1502 are to be strictly construed and Claimant's Mechanic's Lien must be stricken for its failure to comply with the statutory service requirements. (see: Denlinger, Inc., vs. A rg esta, 714 A.2d 1048 (1998)) WHEREFORE, William R. Balaban and Robin Balaban, Owners, respectfully request that Mechanical Electrical Services, LLC's Mechanic's Lien be stricken for failure to serve timely notice within one (1) month after filing as required by 49 P.
