HAUBERT HOMES, INC.,
a Pennsylvania Corporation
LANDSPAN, LLC, a Pennsylvania limited liability company, with its principal place of
business located at 3425 Market Street, Camp Hill, Cumberland County, Pennsylvania,
hereinafter collectively called "Owner", has executed, or is about to execute contemporaneously
herewith, a contract with HAUBERT HOMES, INC., a Pennsylvania corporation, hereinafter
called "Contractor", for the construction of site improvements and other structures upon land of
Owner situate at, 1345 Sconsett Way, Lot 124, Lower Allen Township, Cumberland County,
Pennsylvania, Tax Parcel 13-25-0008-410, being more particularly bounded and described on
Exhibit "A," attached hereto and made part hereof.
NOW, this 1 ~ ~` day of _~~~~. r=i, 2007, before any authority has been
given by the said Owner to the said Contractor to commence work on the said improvements or
to purchase materials for the same, in consideration of the making of the said contract with
Owner and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is
agreed that no lien shall be filed against said improvements or the above property of Owner by
the Contractor, or any sub-contractor, nor by any of the material men or workmen or any other
person for any labor, or materials purchased, or extra labor or materials purchased for the
construction upon said real property, the right to file such liens being expressly waived.

EXHIBIT A
ALL THAT CERTAIN piece or parcel of land situate in the Township of Lower Allen, County of
Cumberland and Commonwealth of Pennsylvania, being more particularly bounded and
described as follows, to wit:
BEGINNING at a point located on the northern right-of-way line of Sconsett Way, twenty-five
(25) feet from the centerline of the same and the front property corner with Lot #125; thence
along said right-of-way with a curve to the left having a radius of one thousand nine hundred
seventy-five and zero hundredths feet, an arc length of sixty-one and zero hundredths feet, a
bearing of North fifty-five degrees twenty minutes fifty-six seconds West with a distance of sixty-
one and zero hundredths feet (R=1975.00' A=61.00', N 55' 20' 56" W, 61.00') to a point on the
same, within a thirty feet (30') wide stormwater and sanitary sewer easement and the front
property corner with Lot #123; thence leaving said right-of-way along the property line of said lot
and within said easement, North thirty-three degrees forty-five minutes fifty-nine seconds East,
a distance of one hundred ten and zero hundredths feet (N 33° 45' 59"E, 110.00') to a point on
the same, within a second stormwater and sanitary sewer easement and the rear property
corner with Lots #71, #121 and #123; thence along the rear property line with Lot #71 and
across the latter easement, South fifty-five degrees twenty minutes fifty-six second East, a
distance of sixty-four and thirty-nine hundredths feet (S 55' 20' 56" E, 64.39') to a point on the
same and the rear property corner with Lots #71 and #125; thence along the property line with
Lot #125, South thirty-five degrees thirty-two minutes nine seconds West, a distance of one
hundred ten and zero hundredths feet (S 35° 32' 09" W, 110.00') to a point on the same, on the
northern right-of-way line of Sconsett Way, the front property corner with said lot and the point
of BEGINNING.
CONTAINING 6,886.19 square feet or 0.158 acres.
BEING known as Lot No. 124 on the Revised Final Subdivision Plan of the Heights of Beacon
Hill, Phase II, recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Plan Book 84, Page 38.
