HETRICK, Owners IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA N0. ~ 1 - 4g/C ~j MUNICIPAL LIEN MUNICIPAL LIEN MUNICIPAL LIEN FOR SERVICES AND SEWER RATES AND NOW, comes Monroe Township Municipal Authority, of 1220 Boiling Springs Road, Mechanicsburg, Pennsylvania, by and through its Solicitors, James D. Bogar, Esquire, and Jennifer B. Hipp, Esquire, and files the following municipal claim against STEVEN M. HETRICK and JOANNE E. HETRICK, husband and wife, adult individuals, owning property located at 1256 Kuhn Road, Boiling Springs, Monroe Township, Cumberland County, Pennsylvania 17007. STEVEN M. HETRICK and JOANNE E. HETRICK are the owners of all that certain lot of ground, including any improvements thereon, being more fully described as follows: ALL THAT CERTAIN tract of land together with improvements thereon erected, situate in Monroe Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows: BEGINNING at a point on the northern line of Kuhn Road (60 feet wide) at the dividing line between Lots 365 and 366 as shown on said Plan; thence by the northern line of Kuhn Road by a curve to the left having a radius of 710.00 feet the arc length of 30.OOfeet and a chord length of 30.00 feet and t a chord bearing of South 50 degrees 27 minutes 49 seconds West; thence continuing by the northern line of Kuhn Road South 49 degrees 15 minutes 11 seconds West 120.00 feet to a point; thence by other property of Penn Products Corporation and the eastern line of Lot No. 368 as shown on said Plan and the center lone of a 30 feet wide drainage easement North 41 degrees 30 minutes West 346.00 feet to a point at the intersection of Lots 368, 369, 360 and 366 as shown on said Plan; thence by the southern line of Lot No. 361 and the center line of said 30 feet wide drainage easement North 49 degrees 15 minutes West 150.00 feet to a point; thence by the western line of Lot Nos. 364 and 365 as shown on said Plan South 41 degrees 29 minutes 59 seconds East 346.64 feet to the Place of BEGINNING. CONTAINING 1.19 acre. UNDER AND SUBJECT to one-half of a thirty (30) feet wide drainage easement along the western and northern lines of said lot. UNDER AND SUBJECT to the revised building lines, covenants, restrictions and reservations as recorded in Miscellaneous Docket Book 211, Page 232. SUBJECT NEVERTHELESS to those restrictions contained in a deed dated May 5, 1975, recorded in Cumberland County Deed Book "D", Vol. 26, Page 155. BEING the same premises which Raymond Delaurentis and Carol L. Delaurentis, husband and wife, by deed dated June 30, 1993, and recorded July 1, 1993, in the Cumberland County Recorder of Deeds Office in Deed Book "J", Vol. 36, Page 544, granted and conveyed unto Steven M. Hetrick and Joanne E. Hetrick, husband and wife. Tax Parcel No. 22-33-0043-048. Monroe Township Municipality Authority hereby files this Municipal Lien for Services and Sewer Rates levied and assessed -2- from January 1, 2006 through and including August 20, 2007. Said Authority services and sewer rates were levied and assessed pursuant to Authority Resolution No. 02-04, same being known as a Resolution of the Board of Monroe Township Municipality Authority imposing user charges to be collected from the owner of each improved property served or to be served by the Authority's sewer system, in conjunction with all prior relevant Resolutions and Ordinances, including, but not necessarily limited to, Monroe Township Ordinance No. 3 of 1978 and Monroe Township Ordinance No. 99-6, as amended; and providing for payment and collection of such user charges. Attached hereto and incorporated herein are the statements forwarded by Monroe Township Municipal Authority to Steven M. Hetrick and Joanne E. Hetrick for sewerage due to be treated from January 1, 2006 through and including August 20, 2007, which services total is in the amount of $1,679.54, which sum was duly assessed against Steven M. Hetrick and Joanne E. Hetrick, and the real property described herein from the date of said billing statements as attached hereto, and for which sum, with interest in the amount of ten (10~) percent, along with penalties and all costs, including attorneys' fees, a municipal lien is claimed against the above-described real property and -3- premises in accordance with the Act of May 16, 1923, P.L. 207, §7, as amended, 53 P.S. §7101, et seq, as amended (Municipal Claims and Tax Liens).
